The wells proposed as the water supply would intercept ground water which is tributary to East Mamm Creek, an over -appropriated stream. Since additional wells would cause injury to senior vested water rights, well permits cannot be issued by this office and we cannot recommend approval of the Gaasch Exemption. We wish to point out that domestic wells could be issued on tracts of land on 35 acres or more in size. If the parcels were of this size, we could issue well permits. Very truly yours, Hal D.
