Mary E. and Daniel Gallacher A parcel of land located in the W 1/2 of Lot 1, of Section 9, T6S, R89W, adjacent to the City of Glenwood Springs at #2 Linden Rd. The site consists of a 4 acre parcel. City of Glenwood Springs Individual Sewage Disposal Systems Existing off of Linden Rd. R/L/SD C/L, R/L/SD, and the City of Glenwood Springs Cl, Commercial Zone District. I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District E, Rural Areas with Severe -Moderate Environmental Constraints, as designated on the Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located adjacent to the residential area of north Glenwood Springs. Improvements on the site include two residences and a studio, all on separate proposed lots, with two existing septic systems. The site is located in an area with moderate to very steep slopes, (25% greater than 40%) with sparse native vegetation. B. Project Description: The applicant proposes to divide the existing 4 acre parcel into 4, one acre lots. Three lots will have existing improvements, while one would be vacant land. III.MAJOR ISSUES AND CONCERNS 1. The City of Glenwood Springs registered no exemption request. 2. Due to steep slopes and soils constraints, and septic systems may be required. 3. Two of the existing structures on the site are pre-existing non -conforming based on front yard setbacks with one dwelling apparently encroaching in the right-of-way for Linden Rd. The approval of this exemption would not effect the pre-existing status of these improvements, nor would it authorized or permit construction, existing or proposed, in the County right-of-way. Any new or additional development would be required to comply with County zoning regulations which do include variance procedures and reduced setback requirements for partially developed frontages with non -conforming setbacks. comments regarding the engineered foundations • • IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the recorded Exemption Plat: A. Each lot may be subject to engineered foundations and septic systems. 2. That the right-of-way for Linden Road be shown on the exemption plat and that all new and additional development shall comply with all Garfield County zoning requirements. 3. That School Impact fees in the amount of $200 be paid for the creation of the one vacant lot. 4. All representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. Practical Description (location with respect to highway, County roads and residences): Adjacent to the City of Glenwood Springs at #2 Linden Road. Said Exemption is to allow the Petitioners to divide a 4 acre parcel into 4 one acre lots. on the above described property. All persons affected by the proposed Exemption are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objections to such Exemption request, as the Board of County Commissioners will give consideration to the comments of surrounding property owners and others affected in deciding whether to grant or deny the request for the Exemption. This Exemption application may be reviewed at the office of the Planning Department located at 109 8th Street, Suite 303, Garfield County Courthouse, Glenwood Springs, Colorado between the hours of 8:00 A.M. and 5:00 P.M., Monday through Friday.
