Galloway A tract of land situated in the S 1/2 SE 1/4 Section 15, T7S, R92W of the 6th P.M., approximately 10 miles south of Silt, off County Rd. 324 SITE DATA: The site consists of an 80 acre tract. WATER: Individual well SEWER: Individual sewage disposal system ACCESS: Proposed access drive off County Rd. 324 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints as designated on the Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Project Description: The applicant proposes to divide the 80 acre tract into two parcels approximately 7.43 acres and 72.5 acres. B. Site Description: The site is located in a rural portion of the County with land uses in the vicinity mainly agricultural/ranching and single family residential. The 7 acre tract currently has no improvements and is separated by County Rd. 324. The 72 acre parcel has a single family residence, and several storage buildings. The Highline irrigation ditch crosses portions of both lots. C. History: Only one previous split has occurred on the site since 1973 and consisted of a greater than 40 acre tract. III.MAJOR ISSUES AND CONCERNS 1. The request qualifies as an exception to the Subdivision Regulations limits on splits by exemption due to its' division by a public right-of-way, County Rd. 324. 2. The applicant has submitted copies of a well permit application with the Division of Water Resources. An approved permit should be submitted. 3. Soil Conservation Service soil information indicates only moderate constraints for individual sewage disposal systems and dwellings. 4. Comments from an adjacent property owner, Mr. J. Gentry, are attached. (See page j, ) • • IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the proposed division qualifies an exception to the Subdivision Regulations limits on splits by exemption as long as the division occurs exactly along the County Rd. 2. That a plat stating "All irrigation ditch easements be recognized and maintained as existing and in place", be included on the plat. That the applicant submit an approved well permit from the Division of Water Resources. 4. That the applicant obtain a driveway access permit for the 7 acre lot from the County Road and Bridge Department, or a letter stating that the Road and Bridge Department would issue the permit at a future date based on a specific location identified on the Exemption Plat. 5. That the applicant submit a letter from the Silt -New Castle Fire District indicating that they serve the site. 6. That the applicant submit $200 in School Impact fees for the creation of one new lot. 7.
