BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed Karl Wm. Geib and Elizabeth G. Geib
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 11.64
acre tract of
land into 2 tracts of approximately 7 and. 4.5
acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

Tract 5, Chelyn Acres Subdivision
from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
To be able to sell present home and hold the West portion for the future,
Land originally purchased with this in mind.
In support of this petition the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access.
(b) Vicinity Map.
(c) Statement on source of domestic water.
(d) Statement on method of sewage disposal.
(e) 100 year floodplain information where
live stream crosses or adjoins said tract.
(f) Fee in the amount of $ 61.00

ACCESS:
Access to Tract 5A now through Tract 5B and would be given an easement;
however, access would try to be arranged across Tract 4, along to old
Railroad Bed.
DOMESTIC WATER:
To be supplied from well that is located on the East half of the tract.
This is an adjudicated domestic well which can have three (3) houses
hooked to it. It is adjudicated for 15 gal/min. and has never been
pumped dry in 10 years of use with house use plus two sprinklers operating.
SEWAGE DISPOSAL:
Seperate septic systems for each tract. Proposed Tract 5B has septic system
at this time.
FLOOD PLAIN:
No live stream crossing or adjoining tracts.
GENERAL INFORMATION:
At present there are 34 tracts in Chelyn Acres with an average size of
3.51 acres. These tracts breakdown es follows: 11 tracts from 1 acre to 1.93
acres; 7 tracts from 2.19 acres to 2.99 acres; 7 tracts from 3.01 acres
to 3.99 acres; 7 tracts from 4.31 acres to 5.88 acres; and 2 tracts of
10.46 acres and 11.64 acres.
If this division of Tract 4 is allowed there would be 35 tracts with an
average size of 3.41 acres, with 29 of the tracts being smaller than the
approximate 4.5 acres split (Tract 5B) and only 1 tract (#4) larger than
the 7 acre Tract 5A.
