Sirwetely, Russell George RG/ef BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. 1973 Section 30 -28 -101(10)(a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution a portion of SW1 SWC, Section 10, Township 6 South, Range 93 West of the 6th P.M., containing approximately .75 acres, more fully hereinafter described, from the definitions of "Subdivision" and "Subdivision land" as the terms are used and defined in C.R.S. 1973 Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations, for the reasons stated below: Please refer to the following marked attachments: a. Exhibit A -Survey Plat by Scarrow and Walker; b. Exhibit B -Sketch Map c. Exhibit C -Location Map. All of SW4SW4i Section 10 was previously owned by the Carlson family. Prior to present subidivision law, area 3 and area 1 (Exhibit B) were separated from the remaining tract and deeded to members of the Carlson family. Area 3 is presently owned by Bernard Collett and is not in issue. Area 1 is owned by Runar J. Carlson under option contract to petitioner. Area 2, owned by Runar Carlson and Sigrid Carlson, present owners of the remainder of SASW4i Section 10, is under option contract to petitioner and is the tract in issue. Areas 1 and 2 are inter- dependent tracts as can be noted on Exhibit A, and have been so used for several decades. The tracts are bounded on the South by County Road 294, on the West and North by agricultural land owned by Bernard Collett and others, and on the East by residential property owned and occupied by Collett. The residence is located on Area 1. The garage, drive- way and irrigation ditch serving the residence on Area 1 are located principally on Area 2. Area 2 is otherwise unimproved. Area 2 has not been an integral part of the balance of SW4SWk, Section 10, being across County Road 294 and largely above the irrigation ditch. Petitioner requests that the County Commissioners find that the division of Area 2 from the balance of SW4SW4i Section 10 is a division not within the purposes or scope of law and regulations governing planning and subdivisions, and as a result of such finding, grant the exemption as requested herein.
