GRAHAM OF COUNSEL AREA CO DE 303 TELEPHONE 2 42 -46 14 Please consider this letter as a request by Charles C. and Lela Foley to convey 1.8 acres of un-subdivided land in Garfield County to Peronelle Burnford Robbins and David Burnford. The 1.8 acre tract of land is located in the vicinity of Carbondale, Colorado and is shown on the plat attached to this letter, prepared by Scarrow and Walker, Inc. on November 12, 1976. The tract of land in question is contiguous to and abuts land recently purchased by Messrs. Burnford and Robbins from Richard Martin, John Huebinger, Jr. and Gerald Hartert and will become a part of the much larger tract of land purchased by Messrs. Burnford and Robbins from Martin, et al. There would be no objection on the part of Messrs. Robbins and Burnford if the Board requires as a condition precedent to its approval, that the 1.8 acre tract become an undivisable portion of the lands acquired by Burnford and Robbins from Martin, et al. The 1.8 acre tract being conveyed by the Foleys to Burnford-Robbins lies south of the south bank of the Roaring Fork River, as indicated by the attached plat. The remainder of Mr. and Mrs. Foley's land, constituting approximately 80 acres, is all located north of the north bank of the Roaring Fork River. Further, the only means of vehicular access to the 1.8 acre tract is through lands acquired by Burnford- Robbins from Martin, et al. On behalf of Mr. and Mrs. Foley, we respectfully request authority and approval of the Board for them to transfer the 1.8 acre tract referred to above to Messrs. Daily, Esq. • • DEED - CHARLES FOLEY and LELA FOLEY, husband and wife, "Granters", sell and convey to PERONELLE BURNFORD ROBBINS and DAVID BURNFORD, "Grantees", the following described real property located in Garfield County, Colorado: A parcel of land situated in Lots 13 and 14 in Section 27, in Lots 1 and 2 of Section 34 and in Lot 3 of Section 35, all in Township 7 South, Range 88 West, 6th P.M., more partic-ularly described as follows: Beginning at a point whence the Witness Point to the South Quarter Corner of said Section 35 bears South 35°54'44" East 5,820.57 feet: Thence North 02°21'00" East 289 feet to a point in the Roaring Fork River, thence South 50°31'00" East 280.06 feet to a point in said river, thence South 71°16'00" East 516.36 feet to a point in said river, thence North 85°36'00" West 719.13 feet, more or less to the point of beginning. Together with all improvements and appurtenances and all water and water rights located upon or used in connection with the real estate described above. Grantors warrant title to the real estate described above against all persons claiming by, through or under them, or either of them, except the lien of the 1977 and subsequent real property taxes and any prior mineral reser- vations existing as of Janaury 26, 1977 and also subject to any reservations and exceptions contained in the patent to the real estate described above. The description of the above described real estate is based upon the survey made by Scarrow & Walker, Inc. of Glenwood Springs, Colorado, dated November 12, 1976, copy of which survey is recorded in the office of Garfield County, Colorado, in Book at Page ~· Granters executed and delivered this instrument on the day of March, 1977.
