Drl nlchouae , Commissioner Ear1..Rhorles , County Attorney Mi 1 dred..,Alsdoxj , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 82_258 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR RONALD AND A. MARIE GIRTON. WHEREAS, Ronald and A. Marie Girton have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 45.19 acre tract described as follows: A parcel of land situated in the SW4SW4 and NW.SW4 of Section 34, Township 6 South, Range 92 West of the 6th Principal Meridian, Garfield County, Colorado, lying Northerly of the centerline of a 60 foot Road Way easement, said Parcel is more fully described as follows: Beginning at the reestablished West Quarter Corner of• said Section in the center of said Road Way; whence the Witness Corner for said Quarter Corner bears: N.89°18'34"E. 30.00 feet; thence N.89°18'34"E. 1320.00 feet to the Northeast Corner of said NW4SW14; thence S.00°32'45"E. along the East lines of said NW1/4SW1 1757.82 feet to a point on said centerline Road Way; tnence along said centerline N.34°04'10"W. 65.81 feet; thence 147.78 feet along the arc or a curve to the left, having a radius of 351.414 feet, the chord of which bears: N.66°07'01"W. and SW4SW 4 146.70 thence thence radius 194.75 thence thence radius feet; N.78°09'52"W. 310.81 feet; 196.48 feet along the arc of a curve to the of 427.985 feet, the chord of which bears: feet; ' N.51°51'42"W. 200.62 feet; 192.27 feet along the arc of a curve to the of 283.384 feet, the chord of which bears: right, having a N.65°0')'47"W. left , : having a N.71°17'54"W. 188.60 feet; thence 5.89°15'53"W. along the South line of said NW14SW4, 320.00 feet to the Southwest corner of said NW4SW4j thence N.00°31'46"W. along said centerline Road Way, also being the west line of said Section 34, 1317.61 feet to the point of beginning. The above described Parcel "B" contains 45.19 acres, more or less. Subject to and together with a 60 foot Road Way easement as described above, being 30 feet on each side of its centerline and running Southeasterly to County Road No. 331. Also subject to a 10 foot utility easement along and adjacent to all boundary lines of the above described parcel of land, except along road ways, also subject to irrigation ditch easements as constructed and in place. The bearing source for the above described parcel of land was established by solar observation. Use N.89°13'11"E. between the Southwest Section Corner and South Quarter Corner of Section 34 in said Township and Range. into 2 tracts of approximately 10.62 and 34.57 acres each, more or less, which proposed divided tracts are more particularly described as follows: TRACT A: A parcel of land being the East and Cattle, Dry Hollow Parcels, Township6 South, Range 92 West Garfield County, Colorado, said as follows: fit 9 P' 3O a'i 275 -feet of Parcel "B" in the Rifle Land situated in the W'S141-4 of Section 34, of the Sixth Principal Meridian, parcel of land is more fully described Beginning at the Northeast Corner of the 1l-SW'4 being the Northeast Corner of said Parcel "B", whence the -West -Quarter Corner of said Section 34 bears: S.89°18'34"W. 1320.08 feet; thence S.00°32'45"E. along the East line of said W'ZSW', 1757.82 feet to a point in the centerline of a 60 foot road way easement; thence, along said centerline road, N.54°04' 10"W. 65.81 feet; thence 147.78 feet along the arc of a curve to the left, having a radius of 351.414, the chord of which bears: N.66°07'01"W. 146.70 feet; thence N.78°09'52"W. 90.62 feet; thence, leaving said centerline road, N.00°32'45"W. along a line 275 feet Westerly of the East line of said Parcel "B", 1167.90 feet to a point on the East-West Centerline of said Section 34; thence N.89°18'34"E. along said Centerline of Section 34, 275.00 feet to the point of beginning containing 10.62 acres, more or less. Subject to and together with a 60 foot road way easement as described above, being 30 feet on each side of its centerline and running Southeasterly to County Road No. 331. Also subject to a 10 foot utility easement along and adjacent to all boundary lines of the above described parcel of land, except along road ways, also subject to irrigation ditch easements as constructed and in place. Use N.89°13'11"E. between the Southwest Section Corner and South Quarter Corner of Section 34 in said Township and Range. Together with 11 interest in the Girton well located in the NW1/4SW4 of Section 34, Township 6 South, Range 92 West of the 6th Principal Meridian to include a 10' maintenance and access easement from said well directly east to Parcel B-1 with a 15 foot easement from the center of said well in all directions. TRACT B: The remaining 34.57 acres. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the property is split by a natural feature, and the impact cre:ited does not warrant further subdivision review, and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; BDOK B(. NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A" and "B" from the above described 45.19 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
