PETITIONER FOR EXEMPTION 19
Pursuant to C.R.S. (1973) Section 30-28-101 (10)(a
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted January 2, 1979, Section 2.02.01 (d) and 3.02.01
the undersigned Gilbert Frontella and Linda G. Frontella
respectfully petition the Board of County Commissioners of
Garfield County, Colorado, to exempt by resolution the division of
a 14.24 acre tract of land into two tracts of approximately7;3894
and 6.8667 acres each, more or less, from the definitions of
"subdivision" and "subdivided land" as the terms are used and
defined in C.R.S. (1973) Section 30-28-101 (10) (a) -(d) and the
Garfield County Subdivision Regulations, for the reasons stated
below:
1. The property being subdivided has been under the
same ownership for at least five (5) years and the proposed
division will create no more than two (2) new tracts under 35
acres in size.
2. The new parcels to be created would meet the
requirements of the applicable agricultural residential zone.
In support of this petition, the petitioner also submits
the following:
A. Map drawn to scale showing proposed lot subdivision
and access
B. Copy of deed
C. Vicinity map
D. Statement on source of domestic water
E. Statement on method of sewage disposal
F. 100 year flood plain information where live stream
crosses or adjoins said tract
G. Evidence of the soil types
H. Copy of Assessor's map showing the property
I. Practical description of property location
J. Fee in the amount of $66.00

STATEMENTS IN SUPPORT OF PETITION
D. Source of domestic water for single-family
residences on the tracts is to be by domestic well (Copy of Well
Permit #130530 attached hereto) and existing cistern serving the
existing residence on the premises.
E. Sewage disposal on the subject tracts will be by
individual septic systems or other unit systems consistent with
Garfield County and state regulations.
F. No live stream crosses or adjoins the tract to be
divided.
I. The property to be divided is situate on Morrisania
Mesa on County Road 340 approximately four miles southeast of the
Town of Parachute and access for each of the tracts to be created
is as indicated on the maps submitted herewith.
