PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Senate Bill 35 Exemption Request
APPLICANT: Gilbert and Linda Frontella
LOCATION: Tract #22 and part of Tract #13
Section 3, Township 7 South, Range
95 West of the 6th Principal
Meridian. Located 4 miles
southeast of Parachute in the
Morrisania Mesa Ranch Subdivision.
SITE DATA: The site is approximately 14 acres
in size.
SEWAGE: Individual Sewage Disposal System
WATER: One existing well and cistern
ACCESS: Off County Road 340
ZONING: A/R/RD
ADJACENT ZONING: A/R/RD in all directions
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site falls within the city/subdivision district in the Comprehensive
Plan.
II. DESCRIPTION OF THE PROPOSAL:
A. Site Description: The site is currently used for the agricultural
purposes of growing hay and fruit trees. There is one old farm house to
the south of the property. The adjacent properties are primarily used for
agricultural purposes.
B. Project Description: The applicants own all of Tract #22 and the
southerly 72 feet of Tract #13. The applicants wish to divide their 14
acre parcel into 2 tracts of approximately 7.3 acre and 6.8 acres. The
proposed southerly tract has an existing house and cistern. The northerly
tract has no existing improvements.
III. MAJOR ISSUES AND CONCERNS:
1.
The site sits in the Morrisania Ranch Subdivision which has been
deemed premature for development by the Board of County
Commissioners due to the potential number of lot splits which
could take place on the Mesa through the exemption process (Ertl
decision, May 23, 1983). The applicants have been advised of the
Board's earlier decision but wish to proceed with their request
at this time.
2. The applicants have one individual well permit which can serve
one house for in-house use only. There is an existing cistern on
the southerly parcel which the applicants wish to use for this
parcel's water supply. The planning staff feels that the best
water supply for the southerly parcel would be an additional
well. The Division of Water Resources is currently reviewing the
feasibility of issuing another well permit for the parcel.
IV. FINDINGS:
1. The proposal meets the acreage requirements of the A/R/RD zone
district.
2. The proposal is in conflict with an earlier decision made deeming
the area premature for additional development.
3. That for the above stated and other reasons, the proposal is not
in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garifeld County.

V. RECOMMENDATION:
BOCC - 8/8/83
Denial of the Senate Bill 35 Exemption Request for the following reasons:
1. The Morrisania Ranch area is premature for further development
due to the potential number of lots which could be created
through the exemption process prior to infrastructure concerns
being adequately addressed.
2. The site is within an existing subdivision which, according to
the Garfield County Subdivision Regulations, should go through
the full subdivision review process to be reviewed for a possible
replatting of that subdivision.
