BACKGROUND Extension to file an Exemption Plat for the Gabossi Exemption# 2 from the Definition of Subdivision Roe Gabossi Adjacent to and north of Highway 6 approximately 1 mile west of Canyon Creek and three miles east of New Castle, Colorado. Specifically, the property is located in the NW Y4 of Section 25, Township 5 South, Range 90 West of the Sixth P. M . 61 .5 acre tract known as the "Bowles Ranch" As you are aware, the Board of County Commis sioners approved an Exemption from the Definition of Subdivision for Roe Gabossi, represented by John Taufer & Associates, on August 5, 2002. This approval effectively subdivided a 6I acre property into 4 lots: Lot I having 20.22 acres , Lot 2 having 34.68 acres, Lot 3 having 3.13 acres, and Lot 4 having 4.34 acres. More recently, the Board approved a request to rezone Lots 3 and 4 from AIR/RD to C/L. The approval for the Exemption required the Applicant satisfy all the conditions of approval and present a plat to the Board for signature within I20 days of the approval which will expire on December 2, 2002. Based on the above, the Applicant had not acted on addressing the conditions listed within the Exemption approval until the Board had taken action on the rezoning request. Now that the Board has granted the rezoning on Lots 3 and 4, the Applicant is currently satisfying the conditions of approval of the Exemption. II. REQUEST The Applicant requests the Board grant a I -year extension from the date of original approval in order to complete the conditions of approval for the Exemption. (Please see letter attached as Exhibit A). This extension would expire on August 5 , 2003. III. STAFF RECOMMENDATION In the past, it has been the practice of the Board to grant I-year extensions for Applicants who have received an approval for an Exemption from the Definition of Subdivision to complete conditions of approval. Staff recommends the Board grant an extension for I -year to August 5 , 2003 for the Gabossi Exemption from the Definition of Subdivision.
