The western edge of the tract is adjacent to public lands administered by this office. Current uses on the BLM include wildlife habitat, livestock grazing, and dispersed recreation such as hunting. 1. Ownership of land adjacent to BLM-administered public land does not grant the adjacent landowner(s) any special rights or privileges for the use of the public lands. 2. The adjacent public lands are currently permitted for livestock grazing. The proponent should be aware of the location of property boundaries to ensure no encroachment occurs on public land. Should any fence construction be considered along the private/BLM boundary, the fence standards should allow for easy passage by big game. This office can provide additional information regarding fence standards upon request. 3. Adjacent public lands are open to hunting and other dispersed recreation activities. The proponents should be aware that hunting and other recreation uses are allowed on BLM-administered land. 4. Any roads, trails, paths, or utilities (water, electric, phone or otherwise) crossing BLM would require right-of-way (ROW) permits from this office. For your information, the property is within the boundaries of the Glenwood Springs Rural Fire Protection District and fire and medical services will continue as it now does. The property owners should be aware that if more that two residences are proposed for the exemption, requirements of the Uniform Fire Code may apply. These requirements would consist of adequate water supply for fire fighting, proper access for fire apparatus and wildland fire mitigation efforts. It should also be noted that it is unknown whether the bridge over Four Mile creek can support the weights of our fire apparatus. Measures should be taken to have the bridge evaluated and signed for maximum vehicle weight. Per our meeting, I wanted to advise you of some potential problems that may hinder our response to the area. As it stands now, there are several houses in the area that we will have difficulty protecting in the event of a fire. Any additional homes will only add to the problem. Our concerns are as follows: 1. There is no designated water supply for fire fighting anywhere in the area. 2. The road is narrow and does not provide the proper turn a rounds. 3. A bridge over four mile creek is not signed for it's capacity. Can we cross it with our heavy fire trucks? 4. The proposed road to the new house seems quite steep. It should not exceed Garfield County Road Standards. 5. The potential for the wildland/urban interface is extreme in that area. I suggest that any new homes meet the NFPA or Forest Service guidelines for mitigation. (Non combustible roofing, brush set backs ect.) 6. Proper addressing of the home is important. Addressing should be on mailboxes as well as in a visible place on the home. As I stated at our meeting, the potential is great for a fire in this area. I would suggest that the Flood's as well as any other persons living in the area be aware of our concerns. We may not be able to contain or adequately fight a fire because of the discrepancies. The applicant's agent, I. Louis Trapani, received said copy and discussed certain areas of disagreement with Mark Bean and Eric McCafferty of the County Planning Department. In all fairness, it must be stated that there were misunderstandings by all parties concerning this petition. 1- In Section II C. Project description, staff placed the existing home and garage on the smaller lot---; that was an error in interpreting the petition. 2- In Section III C, Zoning, there is a discussion of a "proposed new lot" above the existing house. This interpretation of the "new lot" and its building envelope above the house if not consistent with the application. The existing house and garage are on an acre or more of land which does not exceed a 40% slope as required by code and does NOT require any new driveway wh ich staff also includes in their discussion. 3- On Saturday, December 2,1995, William Flood and I. Louis Trapani measured an area of the "upper lot" which included the existng house and garage and determined that there was an area of at least 260 ft by 220 ft (approx. 1.3 acres) which was within the 40% slope parameter. 4- Section III E, Sewer, states "State regulations concerning the ISDS require that placement of ISDS be on slopes no greater than 30%. Given slope and setback requirements, it is doubtful that these regulations can be met. Furthermore, no variances to the less than 30% slope regulation are allowed." It should be noted at this time that any anticipated septic systems would be placed on land which staff has determined to be on slopes of 19% or less. Not only does the above seem contradictory in the two parts of the statement, but no septic systems are proposed in slopes of 30% or more. Actually, the current septic system and future systems would be on slopes of 19% or less in the area between the creek and the house. A- We do not agree that "the proposed exema'ption i$NOT in the best interest of the health, safety. morals, convenience, order, prosperity and welfare of the citizens of Garfield County." B- We do not agree with the staf f recommendation to deny the application on the grounds that the proposal does not meet the various requirements of County Subdivision Regulations, specifically, lot slope requirements and a legal, adequate, domestic water supply for each parcel. It has been denied, as expected. An application to the water court (95CW 115) has been submitted for a 1995 water right for this well. The Floods hold two water contracts with the West Divide Water Conservation District. Each is for one acre foot. One is for the Flood #2 well to serve the • Flood lot split. The West Divide District has submitted a water augmentation plan to the water court (94CW344) to provide West Divide contract holders with water rights to divert water out of priority. Since the West Divide augmentation plan is not yet decreed, the District has applied for, and obtained, a substitute water supply plan which acts as a temporary augmentation plan with certain restrictions. Neither of the Flood wells are covered in the substitute water supply plan. l am confident that the West Divide augmentation plan will be decreed and provide an adequate "legal" water supply for the Flood exemption_ If the Flood well #2 needs to be drilled and used soon, I suggest you consider asking the West Divide District to amend their substitute water supply plan to include it. Another option, if needed, is to request the county to conditionally approve the lot split pending the court approval of the West Divide augmentation plan.
