BOCC 12/4/95 PROJECT INFORMA'T'ION AND STAFF COMMENTS REQUEST: An exemption from the definition of subdivision. APPLICANT: William & Nancy Flood LOCATION: A tract of land located in Section 3, T7S, R8OW of' the 6th P.M.; approximately 4.5 miles south of Glenwood Springs on CR 1 17 (Four Mile Road). SITE DATA: 6.07 Acres WATER: Well SEWER: Individual sewage disposal system ACCESS: Direct access to CR 117 along a shared driveway. R1+,LA'T'IONSI.11P To E CONIPREIIENSIVE PLAN The property is located in District - lb Subdivisions/Moderate Environmental Constraints as designated by Garfield County Comprehensive Plan's Management Districts Map. (The original application was made prior to the adoption ol'the new Comprehensive Plan for Study Area 1.) Il. DESCRIPTION 0Ii'IIE PROPOSAL A. Site Description_ 'l'he property is located south of Chelyn Acres subdivision, immediately west or CR 1 17, approximately 4.5 miles south of Glenwood Springs. An existing single family dwelling and garage are located on the eastern portion of the tract. The topography rises (tour Four !Ville Creek (elevation 6360 feet), which flows through the eastern portion or the property, up to approximately 6800 feet, an average slope of43%. From the creek to the existing house slope has been calculated to be 19%, above the house slope has been calculated to be 48%. The vegetation of the lower portions of' the property consists or shrubs, grasses and deciduous trees, whereas the upper portions attic; property are primarily vegetated by shrubs, grasses and sage. See vicinity map on page Adjacent Lauri Uses: Single family dwellings predominate in this area, as Chelyn Acres is located to the north, Lazy Diamond A subdivision is located to the east and a number of smaller residential tracts are located throughout. Bureau of Land Management owns land which abuts the western portion of the applicant's land. Agricultural land is also located in the vicinity of this proposal. C. Project_1)escription_ The proposal specifies the division of the 6.07 acre tract into two (2) parcels of four (4) and two (2) acres in size. The application indicates the petitioners intend to sell the smaller lot which would consist or the existing home and garage and retain the larger lot for the location of a new, single family dwelling. See sketch map, page 111. MAJOR ISSUES AND CONCERNS Subdivision Regulations_ Section 8:10 (Applicability) of the Garfield County Subdivision regulations gives the Board "discretionary power to exempt 0 division of l(l/1(l from the definition of subdivision and, thereby, from the procedure in these Retrlllations, provided the Board determines /hal such exemption will not impair or c%/ea/ the .s/u/ec/ pu//)ose of the Subdivision Regulations nor be detrimental to the s,'enerul wel/rl/'cc. The Board .shall make exemption decisions in accordance with the requirements u/ these reg'uldltio/is. l,0/lowing a review of the ildlividllal jbcts of each application, in ligh/ of the requirements of the regulations, the Board may approve, conditional!y approve or c%/ly an exemption request." 13. Section 8:52 of the Garfield County Subdivision Regulations states that "No more than cI total of/urlr (-l) lots, parcels, interests or dwelling 711!!1S will be Createdfrom (Iny parcel, a.1' that parcel was. described in the l'eCol'ds of the Gat field County Clerk and Recorder's Office on January 1, 1973, and is not a part of a recorded .sllhdivisioll; however, any pa/'cel lu be divided by exe/nplinn that is split by a public right-%rialy (,Sate or Fe(/era/ higlni'ay, Comity road or mi/road) or natural feature, prove/Ili/lgJollll use of the proposed tracts, and the division occurs along the public right-of-way or natural feature, .such parcels thereby created rncty, in the discretion of the Board% not he considered 10 have been created by exemption with regard to the .iwr (1) lot, parcel, interest or dwelling unlit limitation otherwise applicable; " It appears the property in question existed as a larger parcel of 11.7 acres as of March, 1972, which was subdivided by exemption on or about October 2, 1972, creating two (2) parcels, each at least 5.0 acres in size. See Petition and Resolution on pages The apIi -tilts acquired the northern parcel in February, 1977. See c eed o pages B. Lot Design/Development: According to the sketch map (page 5 ), the applicant indicates that the smaller parcel to be created by exemption would NOT include the existing home, as indicated in the narrative. It appears the larger parcel would include the existing house. Furthermore, the design of the smaller parcel includes a narrow strip of land which runs the length of the northern border of the property. 11 this is necessary to create a parcel that is a minimum of two (2) acres, required by the A/R/RD zone district, then it is questionable whether this is a viable split. Stall has calculated the square footage of the eastern portion of the property, exclusive of the narrow strip of land, and found it to be 1.63 acres in size. Zoning_ The properly exists within the A/R/RD zone district which mandates a minimum lot size of Iwo (2) acres. Technically, the proposed lots meet the minimum lot size requirements of the Zoning Resolution, even though the proposed two (2) acre lot is created as a result of the use of a 25 ft. wide stip going up the hillside. Furthermore, section 5.04.02 of the County's Zoning Resolution of 1978, as amended, requires a building envelope of at least one (1) acre of contiguous land, Tess than 40% slope, for each lot to be created. As stated earlier, slope from the creek to the existing house is approximately 19%; however, above the house, slope has been calculated to be 48%. "I'Iris is the area oldie proposed new lot. Driveways accessing any new development are further constrained by zoning requirements that they be no greater than 14% slope. No information has been presented indicating that regulations regarding building envelopes, driveways and slope can be met. It is staffs' opinion that the proposed new lot does not meet the previously noted criteria for one contiguous acre of land less than 40% in slope. D. Water: The proposal specifies the use of a new well as the water supply for the lot to be created. A preliminary well permit application has been submitted for a new domestic well which would allow the use of up to one (1) acre foot per year. In most cases, the State Engineer determines the spacing of wells in an effort to protect an existing well from a new, adjacent well. It is staff's understanding that, generally, wells must be spaced at least 600 feet apart. Given the dimensions of the smaller lot Orr Z..W. and the location of the 'xisting well, this appears to be impossible. See well permit information on pages `_. No well information concerning the existing well has been submitted; therefore, staficannot comment as to whether the applicant could share the existing well. The applicant has submitted a West Divide Water Conservancy water allotment if c0111ract,•be used in support of a well permit application. See Contract, pages 3 -, I . 11 appears that this well is intended to be for the proposed new lot, but fhe application is not clear on this issue, since there is no documentation regarding the existing well. However, it is the opinion of the County Attorney, based on the recent discussions and correspondence regarding the Springridge 1 subdivision, that this contract only protects water being diverted for use in existing structures and does not protect water to be used at a residence which does not now exist. See attached letters, pages". 'fherelore, an adequate, legal water supply for the lot to be created by exenrp ion has not been demonstrated. 1:. Sewer: The method ol'water treatment for this proposal is specified to be the use of an ISI) system. According to the Soil Conservation Service, soils on-site where the system would logically be placed, are identified as being within the Cochetopa and Fluvaquent classifications. Both soils have severe limitations regarding the placement of ISI) systems and carry the severe designation for building site development. State regulations concerning ISIS require that placement of ISDS be on slopes no greater than 30%. Given slope and setback requirements, it is doubtful these regulations can be met. furthermore, no variances to the less than 30% slope regulation are allowed. t'. Fire Protection: Two letters by the Glenwood Springs Department of Emergency Services have been received indicating that the tract to be subdivided by exemption may create problems in the event of an emergency. See letters attached on pages G. Legal_ Access; Access to CR I I7, for the parcel to be created, would be along a driveway which currently serves the existing residence and crosses over an adjoining piece of property. Assuming the sketch map is correct, an easement for access to the existing residence would be necessary as the driveway would cross the parcel to be created and the adjoining parcel. See sketch map, page 5. l 1. 1:aseruents: All easements regarding access, utilities, drainage, water supply and any additional easements would be required to be shown on an exemption plat. School Impact Fees: The applicant would be required to pay the $200 school impact lee for any new lot that is created, prior to signing of an exemption plat. IV. SUGGESTED h'INDINGS That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That Ior the above stated and other reasons, the proposed exemption is NOT in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. On or about March 21m , 1972 Petitioners entered into a Contract of Sale and Purchase wi.tlt Patrick M. Fitzgerald and Marilyn A. Your Petitioners desire to divide the subject parcel into two parcels, each will be 5.00 acres or more, and each of which wi11 have direct access Lo Four Mile Road. The survey has not yet been completed but the approximate location of tate proposed boundary line is indicated in a dotted line on Exhibit A. 4. Your Petitioners desire to construct a single family residence on the Northerly side of the proposed division line and for that purpose <a water well was drilled on August 29, 1972, which well has been measured to produce 25 gallons per minute. 5. Petitioners have obtained a permit from the County Sanitarian of Garfield County, Colorado for the location of an acceptable septic system on each of the above- described parcels. 6. The existing well of Petitioners, a well drilled by Lhe Fitzgeralds, prior to and within one-quarter of a mile of the Petitioners well, together with the general availability of underground water in this arca causes Petitioners to assert that adequate, potable water should be available to the subject tract. Iiaubold, Hearing Officer in this matter issued an ORDER for a prehearing conference in this matter for 10:00 a.m., on Tuesday, December 12, 1995, and that the provisions of the APA apply and a hearing is required before a license can be revoked. 2. Ori November 3, 1995, without notice to any other parties in this matter, Hal D. Simpson, State Engineer wrote a letter to Scott Balcomb, attorney for West Divide Water Conservancy District and allowed the inclusion of the undeveloped lots in Springridge Subdivision, Filing 1 into said PLAN. 3. Pursuant to the Adjudicatory Procedures Item J(13) [there are two J(13)'s] on page 21 of the Code of Colorado Regulations, "No ex parte communications with or by the state engineer may occur during the pendency of an adjudicatory proceeding, but the State Engineer by letter, a copy to all parties, may request that certain information be provided to him or that certain tasks shall be performed." 4. The State Engineer_ has personally (he states "I" in his .letter to Mr. Balcomb of November 3, 1995) violated the ex parte communication rule and has reversed his office's earlier decisions of May 4, 1994, August 10, 1994 and January 11, 1995, which allowed only existing junior water users to continue to divert via the PLAN. The January 11, 1995 .letter from Jeff Deatherage of the State Engineer's Office to Garfield County Building and Planning stated: 1. "The substitute water supply plan issued to the West Divide Water Conservancy District for the Four Mile Creek drainage was granted to allow existing junior water users to continue to divert in the event that a senior water right placed a call on Four Mile Creek. The plan was issued on an emergency basis for existing development and was not intended as a water supply for new development. This plan was not approved as the source of water for new water users at the Springridge Subdivis:i_on. 5. Pursuant to the Adjudicatory Procedures Rule J(5), Every party to the proceeding shall have the right to present its case or defense by oral and documentary evidence and to submit rebuttal evidence and to conduct such cross examination as may be required for a full and true disclosure of the facts. The November 3, 1995, decision by the State Engineer denied the objectors their rights as provided in the .Code of Colorado Regulations. 6. The July 31, 1995 extension of the PLAN for existing diversions only was approved pursuant to C.R.S. 37-80-120 subject to certain conditions, the first two of which are: 1. An executed water allotment contract specifically identifying the District's allottees under this plan, along with a water diversion accounting sheet, and a map locating the subject diversion structure shall be submitted to this office by October 30, 1995. The District shall notify this office, the Division Engineer, and the Water Commissioner (Joe Bergquist, P.o. As of November. 6, 1995, the District had not complied with the October 30, 1995 deadline for filing the required information with Lhe Division Engineer. Alan Martellaro, Assistant. Division Engineer was contacted personally by Objector Ray D. Walker and Mr. Martellaro confirmed that the Division Engineer's office had not received the required information. 7. The original PLAN of July 29, 1994, of which the July 31, 1995, PLAN is an extension, provided that all wells included in this plan must obtain a new well permit pursuant to Section 37-90-137(2) C.R.S. authorizing operation under this plan. As of November 6, 1995, Mr. Dwight Whitehead of the Division Engineer's Office was unaware of a request by the District for a new well permit for Springridge Subdivision Filing 1 pursuant to Section 37-90-137(2) C.R.S. authorizing operation under the PLAN. The aforementioned letter of January 11, 1995 from Deatherage to Garfield County Planning slated: "Our records indicate that the Springridge Development Phase 1 is not operating under the substitute water supply plan. Phase 1 is currently being supplied by Springridge Well No. 1, Permit No. 43086-F. This permit was issued only pursuant to the plan for augmentation decreed for Phase 1 in Case 93CW51, and not pursuant to the Four Mile. Substitute Water Supply Plan"... 8. On December 23, 1993, the State Engineer's Office issued Well Permit Number 043086E for Springridge Well No. 1 on the condition that the well •he operated in accordance with the Greenwald Children's Irrevocable 'frust Augmentation Plan approved by the Division 5 Water Court in Case No. 93CW51. To date the augmentation pond and other structures assured in Case No. 93CW51 have not been constructed. As provided by the well permit, since the well is not operated in accordance with the terms of said decree, it should be subject to administration by the State Engineer and ordered to cease diverting water. MEMORANDUM TO: Board of County Commissioners FROM: Eric McCafferty RE: Flood Subdivision Exemption (continued from 12/4/95) DATE: 1/19/96 As you recall, the necessity of continuing the Flood exemption request was to allow the applicants enough time to demonstrate they can meet the requirements of Section 5.04.01 and 5.04.02 (2) of the Zoning Resolution, more specifically, that all lots created shall have a minimum building envelope of one (1) acre that has less than 40% slope. There is still some concern by staff that this requirement can be met, as no new information has been presented. After the continued hearing, I toured the property with Mr. Flood and Mr. Trapani in an attempt to better understand the configuration of the proposed lots and attempt to discern their conformance with applicable regulations. Additional investigations using proposed lot configurations and available topographic maps indicated that it was possible that the above zoning regulations may be met. However, it was requested by the Board and reiterated by staff that the applicant have a registered surveyor investigate the site and prepare a survey demonstrating the conformance of the lots. At this time, no new information has been presented. In consultation with the County Attorney, it appears that another impediment may exist to the creation of the proposed lots. Specifically, the applicant must demonstrate that he has an adequate, legal source of water. In the past, for exemptions, the Board has accepted West Divide contracts for that purpose. The use of those contracts was premised upon the use of Reudi water and have resulted in the routine issuance of well permits by the State Engineer. For this exemption, the West Divide contract is premised upon a substitute water supply plan that has not received Water Court approval and has not been approved by the State Engineer for anything except existing development. Until the State Engineer agrees to issue well permits premised upon this type of West Divide contract, the applicant does not appear to have demonstrated an adequate, legal supply of water.
