PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed
FOSTER PETROLEUM CORPORATION
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 35.01 acre tract of
land into 2 tracts of XEY.WagOattily 26.73+ and 9.28+ acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
LONG STANDING ENCROACHMENT
In support of this petition the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access.
(b) Vicinity Map.
(c) Statement on source of domestic water.
(d) Statement on method of sewage disposal.
(e) 100 year floodplain information where
live stream crosses or adjoins said tract.
(f) Fee in the amount of $ 85.01

Petition Exemption
Gentlemen:
The following statements and attached information is provided
as requested in the Petition for Exemption for Parcel #1,
Homestead Ranch, located in Garfield County.
a. Attached hereto is an approved permit application #103492
for a well which has been drilled on Parcel #1 to provide
domestic water for the house upon the subject property.
b. The sewage disposal system utilized for this home is a
septic tank and leach field installed by Mr. Don Ice, the
General Contractor, who built the improvements on the
subject property in accordance with County and State
requirements.
c. Improvements on the subject property were located a minimum
of 25 feet above the flood plane of Mesa Creek which stream
crosses Parcel #1 near the Easterly border of this tract.
