!.APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, an applicant requesting an Exemption from the Definition from SuMivision (Exemption")
shall specifically respond to all the following items below and attach any additional information to be
submitted with this application:
1. Provide a narrative explaining why exemption is being requested
2. Sketch map at a minimum scale of 1"=200' showing the legal description of the property,
dimension, area, and legal description of all proposed lots or separate interests to be
created, access to a public right-of-way, and any proposed easements for drainage,
irrigation, access or utilities.
3. Vicinity map at a minimum scale of 1"=2000' showing the general topographic and
geographic relation of the proposed exemption to the sunounding area within two (2)
miles, for which a copy of U"S.G.S. quadrangle map may be used.
4. Copy of the deed showing ownership by the applicant, or a letter from the property
owner(s) if other than the applicant.
5. Names and addresses of owners of record of land immediately adjoining and within 200
feet of the proposed exemption, mineral owners and lessees of mineral owners of record
of the property to be exempted, and tenants of any structure proposed for conversion.
6. Evidence of soiltypes and characteristics of each type located on the property.
7. Provide proof of legal and adequate source of domestic water for each lot created
8. Method of sewage disposal.
9. Provide a letter of approval of fire protection plan from the appropriate fire district in
which the subject property is located.
10. lf connection to a community or municipal water or sewer system is proposed, submit a
letter from the goveming body stating a willingness to serve the property.
1 1. lt shall be demonstrated that the parcel existed as described on January 1, 1973 or the
parcel as it exists presently is one of not more than three parcels created from a larger
parcel, as it existed on January 1,1973.
12. A $300.00 Base Fee: Applicant shall sign the Agreement for Payment form and provide
the fee with the application.
13. Submit 2 copies of this completed application form and all the required submittal
materials to the Building and Planning Department. Staff will request additional copies
once the Exemption application has been deemed technically complete.

II. EXEMPTION ICABILITY
Pursuant to section 8:50 of the Subdivision Regulations, the Board of County
Commissioners has the discretionary power to exempt i division of land from the definition
of subdivision and, thereby, from the procedure in these Regulations, provided the Board of
County Commissioners determines that such exemption will not impair or defeat the stated
purpose of the Subdivision Regulations nor be detrimental to the general public welfare.
The Board has determined that leases, easements and other similar interests in Garfield
-County owned property, land for oil and gas facilities, and an accessory dwelling unit or twofamily dwelling that are subject to leasehold interest only and -complyin-g with the
requirements of the Garfield County Zoning Resolution, are exempt from thes6 regulations.
A. No more than a total of four (4) tots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the-Garfield County Clerk
and Recordeis Office on January 1, 1973. ln order to qualify for exemption, the parcel
as it existed on January 1, 1973, must have been 35 acres oi greater in size at the timeand not a part of a recorded subdivision; however, any parcel to be divided by
exemption that is split by a public right-of-way (State or Federai highway, County road oi
railroad), preventing joint use of the proposed tracts, and the division occurs along the
public right-of-way, such parcels thereby created may, at the discretion of the Board, not
be considered to have been created by exemption with regard to the four (4) lot, parcel,
interest or dwelling unit limitation otherwise applicable. Foithe purposes oi ciefinition, ali
tracts of land 35 acres or greater in size, created after January'1, 1g73 will count as
parcels of land created by exemption since January 1, 1973.
B. All Gaffield County zoning requirements will be met.
C. All lots created will have legal access to a public right-of-way and any necessary access
easements have been obtained or are in the process of being obtain6d.
D. Provision has been made for an adequate source of water in terms of the leoa! andphvsical qualitv. quantitv and dependabilitv, and a suitabte type of sewageT[i6Gi
to serve each proposed lot. Proof of a legal supply shall be an approved substitute water
supply plan contract; augmentation plan; an approved well permit, legally adjudicated
domestic water source or a contract for a permanent legal supply of dbmesticwater to
be hauled from an outside site for a cistem. Proof of the physicat-supply from a well forthe public meeting, may be documentation from the Division of wat6i Resources that
demonstrates that there are wells within a Ye mlle of the site producing at least five (5)
gallons/minute.
Priol !o the signing of a plat, all physical water supplies using a well shall demonstrate
the following:
1) That a four (4) hour pump test be performed on the well to be used.
2) A well completion report demonstrating the depth of the well, the characteristics of
the aquifer and the static water level;

3) The results of the four (4) hour pump test indicating the pumping rate in gallons per
minute and information showing draw down and recharge;
4) A written opinion of the person conducting the well test that this well should be
adequate to supply water to the number of proposed lots;
5) An assumption of an average or no less than 3.5 people per dwelling unit, using 100
gallons of water per person, per day;
6) lf the well is to be shared, a legal, well sharing agreement which discusses all
easements and costs associated with the operation and maintenance of the system
and who will be responsible for paying these costs and how assessments will be
made for these costs.
7) The water quality is tested by an approved testing laboratory and meet Stateguidelines concerning bacteria and nitrates. For water supplies based on the use of
cistern, the tank shall be a minimum of 1000 gallons.
E. Method of sewage disposal, and a letter of approval of the fire protection plan from the
appropriate fi re district.
F. All State and local environmental health and safety requirements have been met or are
in the process of being met.
G. Provision has been made for any required road or storm drainage improvements.
H. Fire protection has been approved by the appropriate fire district.
l. Any necessary drainage, inigation or utility easements have been obtained or are in theprocess of being obtained.
J. All applicable taxes and special assessments have been paid.

1 Submit 2 copies of this completed application form (pages 1€) including all submittalrequirements and the base fee to the Garfield County Planning DepartmLnt. lt will bereceived and given to a Staff Planner who will review the ippli&tion for technicalcompleteness within 15 working days. The Planning Department may request anextension of time from the Board of County Commiisioners for such ieview not to
exceed an additionalflfteen (15) working days.
Once the application is deemed technically complete, the Staff planner will send you aletter indicating the application is complete in addition to requesting additional copies ofthe application to be provided to the Board of County Commissioners for their review inpreparation for the public hearing.

3. Staff will also send you a "Public Notice Form(s)" indicating the time and date of your
hearing before the Board of County Commissioners. Prior to the public hearing, Staff will
provide you with a Staff Memorandum regarding your requested Exemption application.
(lf Staff determines you application to be deficient, a letter will be sent to you indicating
that additional information is needed to deem your application complete.)
4. lt is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
petition for an Exemption for the public hearing. lf proper notice has not occured, the
public hearing will not occur. Notice requirements are as follows:
Notice by publication, including the name of the applicant, description of
the subject lot, a description of the proposed Exemption from the Definition of
Subdivision and nature of the hearing, and the date, time and place for the
hearing shall be given once in a newspaper of general circulation in that portion
of the County in which the subject property is located at least thirty (30) but not
more than six$ (60) days prior to the date of such hearing, and proof of
publication shall be presented at hearing by the applicant.
Notice by mail, containing information as described under paragraph (1)
above, shall be mailed to all owners of record as shown in the County Assessol's
Office of lots within two hundred feet (200') of the subject lot and to all owners of
mineral interest in the subject property at least thirty (30) but not more than sixty
(60) days prior to such hearing time by certified retum receipt mail, and receipts
shall be presented at the hearing by the applicant.
c.The site shall be posted such that the notice is clearly and conspicuously
visible from a public right-of-way, with notice signs provided by the Planning
Department. The posting must take place at least thirty (30) but not more than
sixty (60) days prior to the hearing date and is the sole responsibility of the
applicant to post the notice, and ensure that it remains posted until and during
the date of the hearing.
5. The Applicant is required to appear before the Board of County Commissioners at the
time and date of the public hearing at which time the Board will consider the request for
Exemption for the subject property. ln addition, the Applicant shall provide proof at the
hearing that proper notice was provided.
6. At or within fifteen (15) days of the meeting, the Board shall approve, conditionally
approve or deny the exemption request. The reasons for denial, or any conditions of
approval, shall be set forth in the minutes of the meeting or in a written Resolution. An
applicant denied exemption may follow the subdivision procedure in these Regulations.
7. Once the Board makes a decision regarding the request for an Exemption, Staff will
provide the Applicant with a letter affirming the action taken by the Board with a list of
conditions, if any, to be completed by the applicant.
L A plat of an approved or conditionally approved exemption shall be presented to the
Board for signature within 120 days of approval. The plat shall include a legal
description of the exempted property, and Exemption Certificate, the County Surveyor's
Certificate and a statement, if four (4) lots, parcels, or interest have been created on the

parcel, that "NOTE: No further divisions by exemption from definition will be allowed."
The plat shall be recorded with the County Clerk and Recorder no later than thirty (30)
days after the Chairman's signature. The Chairman of the Board of County
Commissioners shall not sign a plat of a conditionally approved exemption until ait
conditions of approval have been complied with.
9. The Applicant shall be required to submit a paper copy of the plat and proof that all the
conditions of approval have been met to the Building and Planning Department at least
twenty-one (21) days prior to the expiration of the 120{ay deadline required for signing
the plat by the Board. This is to ensure timely Staff review of the materiats submitted as
well as proper scheduling the plat to be signed by the board.
10. Once all of the conditions, if any, have been satisfied, an Exemption Plat shall be
presented to the Board for signature Wthin 120 days of approval. The plat shall includea legal description of the exempted property, and Exemption Certificate, the County
Surveyods Certificate and a statement, if four (4) lots, parcels, or interest have been
created on the parcel, that "NOTE: No further divisions by exemption from definition will
be allowed." The plat shall be recorded with the Coung Cterk and Recorder no later
than thirty (30) days after the Chairman's signature. The Chairman of the Board of
County Commissioners shall not sign a plat of a conditionally approved exemption until
all conditions of approval have been complied with.

GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT
AGREEMENT FOR PAYMENT FORM

GARFIELD COUNTY (hereinafter COUNTY) and Nan Kelly (hereinafter AppLtCANT) agreeas follows:
1. APPLICANT has submitted to COUNTY an application for an Exemption fromSubdivision (hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 9g-09, asamended, establishes a fee schedule for each type of subdivision or land use review applications,and the guidelines for the administration of the fee structure.
3' APPLICANT and COUNTY agree that because of the size, nature or scope of theproposed project, it is not possible at this time to ascertain the full extent of the costs involved inprocessing the application. APPLICANT agrees to make payment of the Base Fee, established forthe PROJECT, and to thereafter permit additional costs to be billed to AppLICANT. APPLICANTagrees to make additional payments upon notification by the COUNTy when they are necessary ascosts are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost ofconsulting service determined necessary by the Board of County Commissioners for theeonsideration of an application or additional COUNTY staff time or expense not covered by the BaseFee. lf actual recorded costs exceed the initial Base Fee, APPLICANi shall pay additionai billings toCOUNW to reimburse the COUNTY for the processing of the PRoJECT mentioned above.APPLICANT acknowledges that all billing shall be paid prior to the final consideration by thecouNw of any land use permit, zoning amendment, oi subdivision plan.

Subdivision Exemption Application
Dear Mark:
Attached is a Subdivision Exemption Sketch Map and supplemental information for the
above referenced property. The contents of this application are summarized below in
the order of the Exemption Submission requirements listed in Section 8:40 of the
Garfield County Subdivision Regulations.
8:40 SUBMITTAL MAPS AND SUPPLEMENTAL INFORMATION
8:4 I An application for exemption shall be accompanied by the followrng maps:A. Sketch map, at a minimum scale of I ":200', showing the legal description of the property, dimension and
area of all lots or separate interests to be created, access to a public right-of-way, and any proposed

Attached is a 200 scale map of the Lots 1 & 2 which encompasses the entire property
proposed for exemption from subdivision regulations. The approximate location of the
existing residence, well and access drive, proposed new lot line and suggested building

regarding access easements.

8.42 The following supplemental information regarding the proposed exemption shall be filed with the application:A- Copy of the deed showing ownership in the applicant, or a letter from the property owne(s)- ifother than

Attached is a Deed identifying Nan Kelly as owner of the property. Nan Kelly has signed
the application form as the petitioner. Also attached are two quitclaim deedswhich adjusts
a segment of the east boundary of the Kelley property. The attached Sketch Plan
represents the Kelly boundary consistent with these deeds.
B. Names and addresses of owners of record of land immediately adjoining and within two hundred feet
(200') ofthe proposed exemption, mineral owners and lessees of mineral owners of record ofthe property
to be exempted, and tenants ofany structure proposed for conversion;
Attached is the list of property owners within 200 feet. The attached deeds do not show
any severed mineral rights.
C. Evidence ofthe soil types and characteristics ofeach type;
The SCS Soil Map, soil descriptions and evaluation tables are attached covering the entire
property. The applicable soil descriptions and evaluation tables identify steep slopes as
being the main limitation for homesite development in these soil categories. A visit to the
site easily confirms that the Kelley property has relatively little in the way of severe slopes
but does have abundant opportunity to accommodate residential construction.
D. Proof of legal and adequate source of domestic water tbr each lot created. Proofofa legal supply shall be
an approved substifute water supply plan contract or augmentation plan, an approved well permit or legally
adjudicated domestic water source. Proof of physical supply for the public meeting may be documentation

dernonstrate the following:
An existing well is proposed to serve both lots with a well sharing agreement. The well
was constructed under Permit # 173634 (attached) which provides for service to three
single family residences and one acre of irrigation. A pump test of the wellwas conducted
on October 23, 2003 by Samuelson Pump Company, the results of which are reported in
the attached letter signed by Raun Samuelson

All information listed in 1-7 above will be provided prior to presentation of the exemption
plat.

E- Method of sewage disposal, and letter of approval of fire protection plan from appropriate fire district:
The existing residence is served by a septic tank and standard leach field. Sewage
disposal for the proposed lot will also be by ISDS.
The applicant proposes to include in the covenants for the property the requirement that
any new residential construction on either lot be equipped with an intemalfire suppression
sprinkler system. This requirement would not apply to the renovation of the existing
residence but would apply to the replacement of the existing residence. Attached is a
letter from the Carbondale & Rural Fire Protection District stating they have no objection to
the Exemption as proposed.
F- Ifconnection to a community or municipal uater or sewer system, is proposed, a letter from the goveming

body stating a willingness and ability to serve;
G. Narrative explaining why exemption is being requested;
The Applicant desires to divide the 40 acre tract into two parcels of 29.4 acres and 10.9
acres. An existing residence is located on Lot 2. The property is zoned Agriculture /
Residential/ Rural Density allowing a minimum lot size of 2 acres. Each proposed lot is in
excess of two acres in size and Lot 2 contains a building site in excess of two acres which
easily accommodates a sewage leach field with appropriate separations from any
surrounding wells and water bodies. The proposed lots will not adversely impact any
surrounding uses. lntense stands of pinion and juniper trees fully screen the existing and
proposed building sites from surrounding residences. There are numerous parcels in the
surrounding area of similar size. The Callicotte Ranch Subdivision, which is currenfly
being processed by Garfield County is located on the east boundary of the Kelly property
and proposes lots that range from 3 to 7 acres in size.
Access to County Road 1 12 is provided by an easement as described in the attached deed
to Nan Kelly. Access to the Lot 2 building site is provided by an additional easement
across the adjacent property recorded in Book 1491 at Page 79 in the records of the
Garfield County Clerk and Recorder.
H. It shall be demonstrated that the parcel existed, as descrihed on January 1,1973, or the parcel, as it exists
presently, is one (l) ofnot more than three (3) parcels created from a larger parcel, as it existed on January l.
I973; and
The Kelly property was split from property owned by Stephen Callicotte at the time of the
Kelley acquisition. Research of the records at the office of Stewart Tifle in Glenwood
Springs showed no parcel divisions of the Stephen Callicotte property after 1973 other
than the Kelly parcel. The deeds applicable to this history are attached herewith
beginning with the 1963 deed to Stephen Callicotte. The legal description of the
remainder of the Stephen Callicotte property, owned by Rocky Mountain Mansions, llt,
LLC, and currently being processed by Garfield County as the Callicotte Ranch
Subdivision, has been modified by multiple quit claim deeds for the purpose of resolving
boundary conflicts with adjacent properties. These deeds were boundary line adjustmenti
and did not create any new lots.

ACCESS EASEMENT
This Accesg Eescment is madc and antered into this 2O a^v "rMr,zoE1,by and
between ROCI(Y MOUNTAIN MANSIONS III, LLC, a Coloredo limited liebility
company ('RMM") and NAIrI KELLY ("Kelly'').
RECITAL$.i
A. RMM is tbe owna of certain real property as tho same is described on Exhibit "A" asd
depicted on Exhibit "C", attaohed hereto and made a part hereof by this referencc (tho "RMM
Propsrty").
B. Kelly is the owne'r of certain real propertios adjacent to the RMM Propcrty, as the sarne
are described on Exhibit 'Tl" ard depicted on Exhibit "C", attached hereto and madc a part
hereof (the'I(clly Propcrty'').
C. Kelly accesses the Kelly Property by way of a road whioh crosses the RMM Properfy, for
which no easement currently exists.
D. RMM is willing to grant aD easement to Kelly for the purposes described heretn.
GRANT:
NOW, TIIEREFORI}, for good and valuable consideration, the roceipt and sufficiency of
which is hereby acknowledged, tho parties agree as follows.
1. Grant gf,Access Eaqelngnt. RMM hereby conveF and glants, for the uso and
beoeflt of Kclly, her hoirs, porsonal reprcsentatives, successors, grantees and assigns, a
permanent and pcrpetual non-exclusive access easomont for thc purposes of constntcting,
reconstructing maintaining, repairing, replacing and otberwise using an access road over and
asross that portiou of the RMM koperty as shown on Exhibit "C" (the "Acccss Easemenf).
This graat is a ge,neral access grant and shall not be interpreted to be limited to ourrent usos of
tho rciad. Spccifically, Kelly shall be allowcd to uso the easomcnt for access to ao additional
single-family residence on the Kelly Property.
2. Constructioq Within Easement. All road construction and maintenance shall
occur witbin the Access Eascrrcnt. However, Kelly may exceed the Access Easement by up to a
ma,xirnum of fivo (5') foet from thc edges of the Acccss Easernant, on a temporary basis, for
consttuction and maintenance purposes only.
3. Irirpitation ou Easement. Kolly agrees that (i) the Access Eascrnent shall not be
usod for the parking of vehicles or the storage of any materials (except temporarily for thc
prlpope of constucting, majntaining, repairing and replacing improvements within the
Easer{rent), and (ii) no sign, fence, wall, pole, pipe, post, building, stnrcfure or improvements
other lthan the drivanvay shall be constructed within the Access Easoment, oxcept that Kelly may
con"(u"t gates at thc point wherc thc Acccss Easement intersects the RMM Property.

SCS SOIL SURVEY DESCRIPTIONS
36-Empedrado loam, 12to 25 percent slopes.
This deep, well drained soil is on fans and upland hills. lt formed in alluvium and eolian material. Elevation is
6,500 to 9,000 feet. The average annual precipitation is 15 to 18 inches, the" average annual air
temperature is 40 to 44 degrees F, and the average frost-free period is 75 to 95 days.
Typically, the surface layer is brown loam about 5 inches thick. The subsoil is clay loam about 35 inches
thick. The substratum to a depth of 60 inches or more is clay loam. The soil is noncalcareous to a depth of
38 inches and calcareous below that depth" lncluded in this unit are small areas of soils that are similar to
the Empedrado soil but are silt loam or silty clay loam. Also included are small areas of soils that are similar
to the Empedrado soil but have a darker, thicker surface layer. lncluded areas make up about 15 percent of
the total acreage. Permeability is moderate in the Empedrado soil.
Available water capacity is high. The effective rooting depth is 60 inches or more. Runoff is medium, and the
hazard of water erosion is moderate. This unit is used as rangeland or for homesite development.
lf this unit is used for irrigated crops, the main limitation is the slope. lf properly managed, the unit can
produce 3.5 tons of inigated grass hay per acre annually.
The potential plant community on this unit is mainly westem wheatgrass, needleandthread, prairie
junegrass, mountain big sagebrush, and Douglas rabbitbrush. Other plants that characterize this site are
muttongrass, Letterman needlegrass, @mmon snowberry, Utah serviceberry, and antelope bitterbrush. The
average annual production of air-dry vegetation lS about 1,500 pounds per acre. lf the range condition
deteriorates, mountain big sagebrush, Kentucky bluegrass, Douglas rabbitbrush, and annualweeds
increase in abundance.
tf this unit is used for homesite development, the main limitation is the slope. This map unit is in capability
subclass Vile, inigated and noninigated. lt is in the Deep Loam range site.
106-Tridel!-Brownsto stony sandy loams, 12 to 50 percent slopes, extrcmely stony. This map unit is
on tenaces and mountainsides. Elevation is 6,400 to 7,700 feet. The avemge annual precipitation is 12 to
14 inches, the average annual air temperaturc is 42 to 44 degrees F, and the average frost-free period is 85
to 105 days. This unit is about 45 percent Tridell soil and 35 percent Brownsto soil. About 5 to\10 percent of
the surface is covered with stones.
lncluded in this unit are smallareas of Forelle and Evanston soils in the less sloping cleared areas. Also
included are small areas of basalt Rock outcrop and soils that are similar to the Tridell soil but have less
gravel and fewer stones. lncluded areas make up about 20 percent of the total acreage. The Tridell soil is
deep and somewhat excessively drained. lt formed in alluvium and colluvium derived dominantly from
sandstone and basalt. Typically, the upper part of the surface layer is grayish brown stony sandy loam about
2 inches thick. The lower part is grayish brown very cobbly fine sandy loam about 7 inches thick. The upper
5 inches of the substratum is very cobbly fine sandy loam. The next part is cobbly sandy loam about 11
inches thick. Below this is 12 inches of very stony fine sandy loam. The lower part of the substratum to a
depth of 60 inches is very stony loamy sand. Hard basalt is commonly below a depth of about 60 inches.
The soil is calcareous throughout. A thin layer of partially decomposed needles, twigs, and leaves is on the
surface in many places.
Permeability is moderately rapid in the Tridell soil. Available water capacity is low. The effective rooting
depth is 60 inches or more. Runoff is rapid, and the hazard of water erosion is moderate.
The Brownsto soil is deep and well drained. lt formed in alluvium derived dominantly from coarse textured,
calcareous sandstone and basalt. Typicatly, the upper part of the surface layer is light brownish gray stony
sandy loam about 4 inches thick. The lower part is light brownish gray stony sandy loam about 7 inches
thick. The upper 19 inches of the substratum is very gravelly sandy loam. The next 12 inches is very gravelly
loamy sand. The lower part to a depth of 60 inches is gravelly sandy loam. A thin layer of partially
decomposed needles, twigs, and leaves is on the surface in many places.

Permeability is moderate in the Brownsto soil. Available water capacity is low. The effective rooting depth is
60 inches or more. Runoff is. rapid, and the hazard of water erosion is moderate.
This unit is used mainly for livestock grazing or wildlife habitat. lt also is used for limited homesite
development, for Christmas trees, or as a source of firewood and posts.
The potential plant community on the Tridell soil is mainly pinyon pine and Utah juniper with an understory
of bluebunch wheatgrass, lndian ricegrass, Wyoming big sagebrush, and muttongrass. Other plants that
characterize this site are botttebrush squineltail, antelope bifterbrush, and true mountainmahogany. The
average annual production of air-dry vegetation is about 300 pounds per acre.
The potential plant community on the Brownsto soil .\S mainly Wyoming big sagebrush, needleandthread,
lndian ricegrass, westem wheatgrass, and scattered pinyon pine and Utah juniper. Other plants that
characterize this site are bottlebrush squineltail, antelope bitterbrush, and true mountain mahogany. The
average annual production of native understory vegetation is about @0 pounds per acre.
lf the range condition deteriorates, V[oming big sagebrush, cheatgrass, and annual weeds increase in
abundance. Mechanical treatment is not practical because of the very stony surface alld the slope.
Suitable management practices include proper grazing use and a planned grazing system. The slope limits
access by livestock. The limited accessibility results in overgrazing of the less sloping areas. Selective
thinning of the pinyon and juniper stands improves the quality of- the understory for grazing and provides
firewood, posts, and Christmas trees.
The Tridell soil is suited to limited production of pinyon pine and Utah juniper. The average annual
production is 5 cords per acre. The average stocking rate is 150 trees per acre. To ensure sustained yields
and continued use, the kind of wood production should be considered before the stands are thinned or
cieared. Special care is needed to minimize erosion when the stands are thinned or cleared. Thinning the
stands generally promotes the grourlh of understory grasses and young trees.
Only the less sloping areas of this unit are suited to homesite development. The main limitations are the
slope and the stoniness. Ercsion is a hazard in the steeper areas. Only the part of the site that is used for
construction should be disturlced. Topsoil can be stockpiled and used to reclaim areas disturlced during
construction. The gravel and cobbles in disturbed areas should be removed if the site lS landscaped,
particularly in areas used for lawns. Areas adjacent to hillsides are occasionally affected by runoff, which
may be accompanied by the movement of rock debris. Population growth has resulted ln increased
construction of homes in areas of this unit.
This map unit is in capability subclass Vile, noninigated. The Tridell soil is in the Pinyon-Juniper woodland
site, and the Brownsto soil is in the Stony Foothills range site.

The Nan Kelly property at 1022 County Road 112 is located inside the service area of the
Carbondale & Rural Fire Protection District. The property is served by the District for both fire
and emergency medical services.
The proposal to provide fire protection by installing automatic fire sprinklers in any new
residential structures is acceptable.
The new lots created in by the proposed subdivision are subject to impact fees adopted by the Dishict.
The developer will be required to enter into an agreement with the piitrict for the payment of
development impact fees. This payment is due prior to the recording of the final piai. Fees are based
upon the per lot impact fee adopted by the District at the time the agreement is exlcuted. The current
impact fee is $417 per lot.

This letter ic in response to your letter to Nan Kelly dated March 8, 2004, and condrhon No. 4 of
the Board of County Commissioner resolution pertaining to the Kelly Exemption. We have reviewed
recorded documents that provide assess to the Krlly Property from County Road 1 l2;-specifically (i) the
eassment for acccss, ingrcss and cgress and utilities described in the deed to Nan Kelly recordcd Aprii 23,
1993 in Book 860 at Page 561, as Reception No. 446705 (Stewart Title of Glenwood Spnngs order No.
93021162), and (ii) the Access Easernent recorded July 9, 2003 in Book 1491 at Page 79 as Receptloil No.
631401, which is shown on the Kclly Exemption Plat prepared by High County Engineering. We find
that the easement rights granted in these recorded documents can provide legal access t0 Lot 2 as well as
Lot I of the Kelly Exemption.

Dear Ron,
As you are aware, on Monday, March 8,2004,the Board of County Commissioners approved (by a
vote of 3 to 0) the request for an Exemption from the Definition of Subdivision for a properly owned
byNan Kelly a with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval.
2. That the applicant shall have 120 days to present a plat to the Commissioners for signature
from the date of conditional approval of the exemption.
3. That the following plat notes shall appear on the Final Plat:
a) Only one last division by exemption from the rules of Subdivision will be allowed.
b) No open hearth solid-fuel fireplaces will be allowed anywhere within an exemption. One
(1) new solid-fuel buming stove as defied by C.R.S. 25-7-401, et. sew., and the
regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling
units will be allowed an unrestricted number of natural gas buming stoves and
appliances.
c) All exterior lighting will be the minimum amount necessary and all exterior lightingwill
be directed inward and downward, towards the interior of the subdivision, except that
provisions may be made to allow for safety lighting that goes beyond the property
boundaries.
d) Foundations and tndividual Sewage Disposal Systems shall be engineered by a
Professional Registered Engineer within the State of Colorado.
e) Colorado is a "Right-to-Farm" State pursuant to C.R.S. 35-3-101, et seq. Landowners,
residents and visitors must be prepared to accept the activities, sights, sounds and smells
of Garfield County's agricultural operations as a normal and necessary aspect of living in
a County with a strong rural character and a healthy ranching sector. All must be

who will be responsible for paying these costs and how assessments will be made for
these costs;
d. The water quality be tested by an independent testing laboratory and meet State
guidelines concerning bacteria and nitrates.
8. The Applicant shall map and inventory the properby for Garfield CountyNoxious Weeds' The
Applicant shail be required to provide a map or sketch that has the locations of weed
infestations. The Applicant shall provide a weed management plan for the inventoried noxious
weeds. These documents shall be approved by the County Vegetation Management Director
and presented to the County Building and Planning Department prior to final plat.
As required in the county land use regulations and as a result of this approval, you have 120 days
from ihe date of this approval (until July Sth, 2004) to satisff these conditions of approval and
provide a final exemption plat to the Board of County Commissioners for their signature. If you are
lnable to complete these conditions and submit the plat by this date, you may request the Board grant
an extensiorr; ho*.u.r, this request must be made 30 days prior to the original expiration date to be
considered before the Board.

DECLARA TION OF WATER WELL USE AND MAINTENANCE
THIS DECLARATION is made this

day of July, 2004, by NAN KELLY
("Declarant"), whose address is 1022 County Road 112, Carbondale, CO 81623'
WHEREAS, Declarant is the owner in fee of those real properties described
as parcel 1 and Parcel 2 within the plat of the Kelly Subdivision Exemption, Garfield
County, Colorado. Said Parcel 1 and Parcel 2 are refened to hereinafter collectively as
"the Parcels."
WHEREAS, Declarant also is the owner of a water well ("Well") located on
parcel 1 and permitted under Colorado Division of Water Resources Well Permit No'
173634 (Division 5), for domestic and irrigation uses of not more than three single family
dwellings; and
WHEREAS, by this Declaration, it is the intent of Declarant to establish a
regime governing the joint use of the Well by the future owners of the Parcels (the
"Owners").
NOW THEREFORE, the Declarant sets forth the regime goveming joint use
of the Well by the future Owners of the Parcels as follows:
1. The Owner of Parcel 2 shall be deemed to own an undivided
one-third (t/3'd) share of the subject Well permit, Well, and associated pump, fittings at
the Well
'head,
meters (whethir existing now or to be installed at a later time),
pumphouse, foot valves, and any pipes or pipelines and any other structures which are
jointly used.
2. The Owner of Parcel 1 shall be deemed to own an undivided
two-thirds (2l3rds) share of the subject Well permit, Well, and associated pump, fittings
at the Well head, meters (whether existing now or to be installed at a later time),
pumphouse, foot valves, and any pipes or pipelines and any other structures which are
jointly used.
3. No Owner is deemed to have any ownership right in and to any
pipe, pipeline or other structure used or required solely by the Owner of the other Parcel,
*hi.t may utilize any portion of the water flowing from this Well and its structures. This
Declaration does not intend to relate to such individually owned or used rights or
structures. Nothing in this Declaration shall be construed to give any Owner any rights to
such non-shared property of the other Owner nor to obligate any Owner to pay any costs
associated with non-shared structures.

4. The Owners shall cooperate with each other at all times in all
matters necessary to promote the proper construction, completion and functioning and
use of the water system in such manner as to provide to their respective uses an optimum
water supply on demand at all times possible based upon the natural availability of water.
The Owners shall agree to not waste water and to endeavor to use no more than their
respective shares of the available water. At this time it is agreed that no individual water
meters must be installed. If at any time after the date hereof, any Owner requires that
meters be installed, then each of the Owners shall install meters at their individual
expense. Waste or over-use shall be deemed to be a violation of this Declaration for
which the non-defaulting Owner may seek remedy at law or equity for damages or for
injunctive relief, or both. Irrigation uses shall be limited to not more than ll3 acre of lawn
and garden irrigation on Parcel 2 and 213 acre of lawn and garden irrigation on Parcel l.
Unless otherwise agreed by each Owner, the Owner of Parcel 2 shall use no more than
one-third (1/3) of the water legally allocated to the Well (i.e., 5.00 g.p.m.) and the Owner
of parcel 1 shall use no more than two-thirds (213) of the water legally allocated to the
Well (i.e. 10.00 g.p.m.). In the event the water physically available from the Well is less
than the legally available amount, then each Owner shall proportionately reduce the
consumption of same to the amount actually available. In no event shall the Well be
pumped at arate exceeding fifteen (15) gallons per minute. Any household use of the
Well water must provide for return flow through an individual disposal system of the
non-evaporative type, returning the water to the watershed in which the Well is located.
5. Declarant shall be responsible for the initial cost of constructing
the Well system, any water tank, pump house and any jointly-used pipe lines. Following
the initial construction, the acfual and continuing costs of operation, maintenance,
construction, extension, upgrading, cleaning, repairing and all other work required on
shared components of this water system to cause the water at the Well to become and
remain available to deliver water to the Owners shall be shared by the Owners in
proportion to their share in the Well. This Declaration shall relate only to costs incurred
after the date hereof. Electrical charges for the operation of the Well shall be shared in
proportion to the water allocated to each Owner. No operational costs will be charged to
uny O*r.r until such Owner actually makes a physical connection to the Well and begins
using water from same.
6. Subject to the provisions in paragraph 4 above, any Owner who
has been using water from this system and at any time elects not to share in costs,
necessary repairs, maintenance, replacement and the like necessary to maintain the Well
and deliver ihe subject water, shall not receive water from the systern. At such time as
said electing Owner chooses to resume use of water from the system, said Owner may do
so upon ,.i.bu.r"*ent to the other user the full cost of said Owner's share of such
expenditures, with legal interest retroactive to the expenditure date.
7. The Owners agree to cooperate in the future maintenance,
operation, repair, replacement or, improvement of all common facilities. In the event the
Owners are unable to agree on any required maintenance, repair, replacernent

improvement, any Owner shall be entitled to undertake the minimal maintenance, repalr,
replacement o, irnprorement necessary and essential for proper functioning of the
common facilities. In the event an Owner determines to undertake such work unilaterally,
such owner shall notiff the other owner in writing. The owner undertaking the work
shall, upon completion, provide the other Owner with a written statement of work
performed and the other Owner's proportionate share of the cost of same. In the event an
Owner fails to pay the proportionat" ,hu.. of any amount due within thirty (30) days after
presentment, the bwner which has paid such cost and expense shall be entitled to pursue
any rerredy available at law or in equity. The Court, in its discretion, may award to the
prevailing party Court costs and attomey's fees incurred.
8. Declarant hereby creates and reserves pelTnanent, non-exclusive
easements across the portions of Parcel 1, designated as "Well and Utility Easement" and
"ZO ft. Well Ease*"irt" on the final plat of the Kelly Subdivision Exemption, and as
described on Exhibit A, attached hereto, as necessary and sufficient for the benefit of the
Owners of Parcels 1 and 2, as users of the Well, pump and common pipeline and
treatment system and structures, and also creates and reserves a non-exclusive easement
for non-shared or individual pipelines conveying water to the respective Parcels over and
across said "well and utility Easement" and "20 ft. well Easement".
9. Each Owner shall agree to not interfere at any time with the
proper use by any other Owner of its interest in any water structure and shall indemniff
*d notA harmless all other Owners and users from any loss or damage or injury caused
by the acts of said indemniffing Owner.
10. The term hereof shall be perpetual. Notwithstanding the
foregoing, however, in the event that a well permit is issued for Parcel 2 allowing
household uses and the newly permitted well as drilled produces two (2) or more g.P.m',
this Declaration shall becomi null and void, and ownership of the Well and its associated
permit and facilities shall then automatically revert to the Owner of Parcel 1.
1 1. This Declaration and the covenants contained herein are
intended to and shall run with the titles to those real properties described as Parcel I and
parcel 2 within the plat of the Kelly Subdivision Exemption, Garfield County, Colorado,
and shall be binding upon and inure to the benefit of the Owners thereofl, and their
assignees or successors.
12. The laws of the State of Colorado shall govern the validity,
effect and construction of this Declaration.
13. This Declaration may not be modified in any manner except by
an instrument in writing sigUed by the Owners of each of the Parcels.
