WIIERE11S, Petitioner J. LOUISE KEMME, also known as
JOSEP1111 LOUISE KEMME, has heretofore petitioned the Board of
County Commissioners of Garfield County, State of Colorado
("Commissioners") for an exemption pursuant: to 11 3.02.01 Sub-
division Regulations, Garfield County, Colorado (Sept. 1972) ,
as amended, and 12 Colo. Rev. Stat. .4 30-28-1.01 (10) (d) (1973) ,
to permit the conveyance, exempts from the other requirements
contained in the aforesaid regulations, of certain real pro-
perty situate in Garfield County, State of Colorado, described
as Parcel No. 1 and Parcel No. 2 in the attached Exhibit "11"
to this. Resolution.
WIIEREAS, Petitioner is. presently the record owner of
said Parcel No. 1 and Parcel No. 2.
WHEREAS, said Parcel No. 1 and Parcel. No. 2 were created
as to present conformation and size by the taking and construc-
tion by the Commissioners of a public project, a bridge across
the Roaring Fork River (coincidental with the exLc'rie;:i.on of 27th
Street, City of Glenwood Springs, Colorado) and a County Road
following Lhc entry of an Order. of Possession entered by Llic
District Court:, Garfield County, Colorado, in C:i.v:i.l. Action No.
6370, Septernber. 10, 1968.
WIIEREAS, title to the aforesaid bridge and County Road,
forming Parcel. No. 1 and Parcel No. 2, was vested :i.n the Commis-
sioners by Rule and Order entered by the aforesaid Court May 1,
1975.
WHEREAS, it appears and the Commissioners :;o find that

that.Parcel No. 1 and Parcel No. 2 (a) conforms with the
.Geheral':Plan and Zoning, (b) are suitable for subdivision,
:(c) relate to adjacent land and development, (d). are adequately
served by a primary road, (e) are served by an adequate water
supply and distribution system, and (f) and will be served by
an adequate sewage collection and treatment system.
NOW, THEREFORE, upon the motion of Commissioner

and unanimously carried, the real property described as Parcel
No. 1 and Parcel No. 2 herein is, for the reasons set forth
hereinabove, hereby exempted from the terms "subdivision" and
"subdivided land" as set forth in Q 1.02.07(d) Subdivision
Regulations, Garfield County, Colorado (Sept. 1972), as amended,
and 12 Colo. Rev. Stat. § 30-28-101(10)(d) (1973).

Parcel No. 1
A parcel'of.-land situated in the NW4NE4 of Section 21, Township
6 South, Range 89 West of the Sixth Principal Meridian, lying
Southerly•o,f the Northerly line of said NWaNEk, said Parcel of
land is described as follows:
Beginning at a point on the Northerly line of said NWkNE4 whence
the Northeast Corner of said Section 21 bears: N. 89°45'00" E.
1902.32 feet; thence N. 89°45'00' E. 436.77 feet along the Northerly
line of said NW%NE4i thence S. 2.0°10'00" E. 27.15 feet; thence S. 71°
45'00" W. 95.31 feet; thence 225.31 feet along the arc of a curve
to the left, having a radius of 408.10 feet, the chord of which
bears S. 55°56'00" W. 222.46 feet; thence 74.51 feet along the arc
of a curve to the left, having a radius of 527.46 feet, tke chord
of which bears: S. 36°04'11"'W. 74.45 feet; thence N. 63°25'01" W.
55.76 feet; thence N. 20°00'00" W. 226.95 feet to a point on the
Northerly line of said NWkNE4, the point of beginning.'
The above described parcel of land contains 1.18 acres, more or less.
The above described parcel of land is subject to the Atkinson Canal.
Parcel No. 2
A parcel of land situated in the NINE4 of Section 21, Township
6 South, Range 89 West of the Sixth Principal Meridian, lying
Easterly of the Easterly right -�f -way line of a County Road as
constructed and in place and Westerly of the Westerly bank of the
Roaring Fork River, said parcel of land is described as follows:
Beginning at a point on the Easterly right-of-way line of said
road whence the East Quarter Corner of said Section 21 bears:
S.42603'02" E. 2208.49 feet, thence 183.46 feet along the arc of
a curve to the left, having a radius of 1195.92 feet, the chord
of which bears: N. 24°36'19" W. 183.28 feet; thence N. 29°00'00"
W. 89.28 feet; thence 192.16 feet along the arc of a curve to the
right, having a radius of 904.43 feet, the chord of which bears:
N. 22°55'00" W. 191.80 feet; thence 424.88 feet along the arc of
a curve to the right, having a radius of 427.46 feet, the chord
of which bears: N. 11°38'30" E. 407.61 feet; thence 170.10 feet
along the arc of a curve to the right, having a radius of. 308.10
feet, the chord of which bears: N. 55°56'00" E. 167.95 feet; thence
N. 71°45'00" E. 98.66 feet to a point on the Westerly bank of said
river; thence S. 20°10'00" E. 271.65 feet along said river bank;.
thence S. 05°32'00" E. 255.00 feet along said river bank; thence
S. 00°16'00" E. 248.00 feet along said river bank; thence S. 08°20'
00" E. 128.00 feet along said river bank; thence S. 15°50'00" E.
79.43 feet along said river bank; thence N. 87°05'00" W. 280.78
feet to a point on the Easterly right-of-way line of said road,
the point of beginning.
