Dear Mr. Michaelson,
we are in receipt of your subdivision exemption referralfor a 1.g2 acre tract located betweencarbondale and Glenwood springs. rne apptlcani I p;;p"ring to split this tract into two 0.96acre parcels' Although not specified, it appears the proposed water supply source for theparcels will be on-site wells.
The Colorado River system and its tributaries at this location are over-appropriated. Assuch' well permits applications in new subdivisions ,rrt u, evaluated to determine if other waterrights would be iniured considering the cumulative etfect of all proposeo wetts. lt is likely thatin many circumstances well permiis coutd not be issued by our otfice without a water courtapproved plan for augmentation' However, under current statutes, if the Garfield Board ofcounty commissioners approves this sp_lit by exemptiln as defined in section 30-28-101 (1oxd)c'R's" our office must evaluate the well peimit applications as if the division of land occurredprior to June 1 ,1972.
Under current laws, section 37-92-602(SxbxllxA) c.R.s., and hydrologic conditions, itappears that our office could in this circumstan"e'iiprbv" welt permits for ordinary householdpurposes inside the single-family dwellings provid"a in"t the wells would be the onty wells onthe individual parcels, return flows woulO h" to the same slream system in which tho wells arelocated via non-evaporative disposal systems, and that evidence is submitted showing that thecounty has approved the parcelas an exemption. Absolutely no outside uses, including irrigationand the watering of animars, are ailowed under thi; iype;f permit.

Dear Mr. Michaelson,
We are in receipt of your subdivision exemption referralfor a 1 .g2acretract located betweenCarbondale and Glenwood Springs. The applicant is proposing to split this tract into two 0.96acre parcels. Although not specified, it appears the proposed waier supply source for theparcels will be on-site wells.
The Colorado River system and its tributaries at this location are over-appropriated. Assuch, well permits applications in new subdivisions must be evaluated to determine if other waterrights would be injured considering the cumulative effect of all proposed wells, lt is likely thatin many circumstances well permits could not be issued by our office without a water courtapproved plan for augmentation, However, under current statutes, if the Garfield Board ofcounty commissioners approves this split by exemption as defined in section 30-28-101 (1oxd)C.R.S', our office must evaluate the well permit applications as if the division of land occurredprior to June 1 ,1972.
Under current laws, section 37-92-602(3)(bxllxA) c.R.s,, and hydrologic conditions, itappears that our otfice could in this circumstance approve well permits-for orlinary householdpurposes inside the single-family dwellings provided that the wells would be the only wells onthe individr:a! parcels, return flows would be to the sanne streenn systorn in ,shich the .,ve!ls arelocated via non-evaporative disposal systems, and that evidence is submitted showing that theCounty has approved the parcelas an exemption. Absolutely no outside uses, including'irrigation
and the watering of animals, are allowed under this type oi permit.
