GARFIELD COUNTY Building and Planning Department INTER -OFFICE MEMO May 10, 1999 To: Board of County Commissioners From: Building & Planning, Kit Lyon Re: Fyrwald Amended Plat Honorable Board Members: Attached hereto please find: • A letter dated 4/21/99 from High Country Engineering requesting an Amended Plat (page 1) • An 11"$ 17" copy of the Amended Plat (page 2) • A sketch showing the proposed plat with the existing errors surperimposed, which has been provided for demonstration purposes only (page 3) Pursuant to Section 6:10 of the Garfield County Subdivision Regulations of 1984, an amendment can be made to a recorded plat: 6:10 An amendment may be made to a recorded plat, if such amendment does not increase the number of subdivision lots or dwelling units, result in the major relocation of a road or add new roads. The amended plat shall be submitted with a narrative explanation of the reason for the application and the consent of all land owners involved to the Garfield County Planning Department for review and comparison with the previously recorded plat. Within thirty (30) days of submittal, the amended plat shall be brought before the Board of County Commissioners for review and decision. If approved, a plat title "Amended Final Plat" shall be signed and dated by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County within ninety (90) days. The purpose of amending the plat is to correct a surveying error on the original plat. Building #4 was not correctly located and a road easement was unwittingly placed through Building #4. By re -aligning the road easement and lot lines, the applicant is correcting the existing error. No increase in units or major road relocations are proposed. The Fyrwald Amended Plat complies with the purpose of the Section 6:00. The County Surveyor, Sam Phelps, has received the amended plat for review. To date, no comments have been received. The amended plat must also meet the standards in Section 5:00 of the Garfield County Subdivision Regulations of 1984, which sets forth the requirements of a final plat. The Fyrwald Amended Plat meets these standards. Based on these findings, Staff recommends that the Fyrwald Amended Plat be placed on the Board of County Commissioners Consent Agenda for June 7, 1999. Assuming the Garfield County Surveyor approves of the plat amendments, Staff recommends that the original Fyrwald Amended Plat be signed at that time. Included in the submittal are five 11x17" sets, one 24x36" set and the required review fees. The purposes for the amended plat is to relocate lot lines and easements to match the existing condition. A recent survey revealed that Existing Building #4 had been inaccurately located on the previously filed Fyrwald Exemption Plat, Reception No. 506023. This caused the previously platted 60' Access and Utility Easement to run approximately 11' deep into the building. Therefore, I have amended the locations of the interior lot lines and easements to accommodate the existing conditions and the proposed commercial development.
