when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 81-315
RESOLUTION CONCERNED WITH THE DENIAL OF.SUBDIVISION EXEMPTION REQUEST
BY GLEN EASH
WHEREAS, The Board of County Commissioners of Garfield County has
received an application from Glen Eash for a subdivision exemption relating
to 4.5 acres of land in SW14.NW4 of Section 26, T6S, R89W of the Sixth Prin-
cipal Meridian; and
WHEREAS, the Board of County Commissioners has carefully considered
the said application together with the recommendation of the Garfield
County Planning Department, and has further viewed the site of the proposed
exemption and has considered the circumstances surrounding the said sub-
division exemption request and the subject property; and
WHEREAS, the Board of County Commissioners has made the following
determination of fact:
1. That said parcel was created in part by Resolution of this
Board No.. 77-89 and the restriction as follows:
Further, that the creation of said 3 acre tract will not result
in ownership by any third party other than the presently existing
adjoining land owner.
2. That at the time of the above resolution, the applicant, Glen
Eash, was an adjacent property owner, so that the above restriction is
still in existence and the above application is in violation of said
restriction.
3. That Resolution No. 80-65 of the Board of County Commissioners
of Garfield County establishes the criteria for consideration of applications
for subdivision exemption. That in Section 1 of said Resolution, the
Commissioners must determine that the lot to be created is in compliance
with the subdivision regulations of Garfield County.
4. Section 5.01 of the Garfield County Subdivision Regulations
set forth the criteria as to the suitability of land for subdivision.
5. That the proposeu .vision of the subject property, because of
steep topography and potentia natural hazards, features, and conditions
associated with the subject property, makes the division likely to be
harmful to the health, safety, and welfare of the future residents of the
proposed divided lands.
6. That the above Exemption Resolution (80-65) also requires that
the proposed division of land be in compliance with the Garfield County
Zoning Resolution. That the subject lands are not suitable for subdivision
under criteria established by the Garfield County Zoning Regulations, as
set forth in sections 5.04.02 and 5.04.03 of said regulations.

NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners
of. the County of Garfield, State of Colorado, that the request for exemption
from the Garfeild County Subdivision Regulations and the Subdivision laws
of `'the State of Colorado by Glen Eash be and hereby is denied.
