PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972
Section 1.02.17 (d) and 3.02.01 the
respectfully petitions the Board of
Garfield County, Colorado to exempt
and amended April 14, 1975,

of that tract of land containing thirty-five (35) acres, more or
less, described on Exhibit "A" attached hereto and incorporated
herein by this reference into two tracts containing approximately
6.5 acres acres each, and one tract containing approximately
23 acres as depicted on Exhibit "B" attached hereto and incorporated
herein by this reference, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in
C.R.S. 1973 Section 30-28-101 (a) -(d) and the Garfield County
subdivision regulations, and in support thereof states:.
1. That the requested division of the subject property is
consistent with the

3. Petitioner believes that a permit for an adjudication of
a domestic water well can be obtained for the supply of domestic
water to each of the divided tracts. Petitioner further believes

property as requested is responsive to the public need for
additional developable residential lots with adequate water supply

5. The proposed tracts will have adequate access from
County Road 335.
Petitioner submits the fee in the sum $85.00 in connection
with this petition.

EXHIBIT "A"
A parcel of land situated in the Eh of Section 12, Township
6 South, Range 92 West, and in the W1 of Section 7, Township
6 South, Range 91 West of the Sixth Principal Meridian, Gar-
field County, Colorado, more particularly described as follows:
Commencing at an iron post and brass cap properly marked and
found in place for the North Quarter Corner of said Section 7,
thence S. 35°02'39" W. 5652.48 feet to a point on the North
right-of-way of County Road No. 335, the True Point of Beginning
(whence the East Quarter Corner of said Section 7, a rock
properly marked and found in place, bears N. 70°35'28" E. 6201.73
feet); thence North 1949.91 feet to a point on the South Bank of
the Colorado River; thence N. 73°48'58" E. along said South Bank
562.98 feet; thence N. 68°16'15" E. along said South Bank 173.00
feet; thence leaving said South Bank S. 00°48'04" E. 2013.15
feet to a point of said North right-of-way of County Road No. 335;
thence S. 77°47'09" W. along said North right-of-way 746.42 feet
to the True Point of Beginning; containing 32.4972 acres more
or less.
Subject to any easements or rights-of-way for existing power
transmission lines across above described parcel.

'A parcel of land situated between the existing South Bank of
the Colorado River and the existing centerline of the Colorado
River in the E1/2 of Section 12, Township 6 South, Range 92 West,
and in the W1 of Section 7, Township 6 South, Range 91 West of
the Sixth Principal Meridian, Garfield County, Colorado, more
particularly described as follows:
Commencing at an iron post and brass cap properly marked and
found in place for the North Quarter Corner of said Section 7,
thence S. 50°28'33" W. 4207.76 feet to a point on said South
Bank of the Colorado River, the True Point of Beginning (whence
the East Quarter Corner of said Section 7, a rock properly
marked and found in place, bears N. 88°54'47" E. 5850.35 feet);
thence N. 09°20'39" W. 193.51 feet to a point on said centerline
of the Colorado River; thence N. 80.39'21" E. along said centerline
557.08 feet; thence N. 70°33'22" E. along said centerline
152.55 feet; thence leaving said centerline S. 19°26'38" E. 117.94
feet to said South Bank of the Colorado River; thence S. 68°16'15"
W. along said South Bank 173.00 feet; thence S. 73°48'58" W.
along said South Bank 562.98 feet to the True Point of Beginning;
containing 2.5028 acres more or less.

We have reviewed the material submitted for the above
referenced exemption application. The developer proposes to
use wel is for the water supply which would intercept ground water
tributary to the Colorado River at a point where there is still water
available for appropriation. This office can issue individual
domestic well permits to individual lot purchasers and we recom-
mend approval of the Kerst Exemption.
