(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 Section 1.02.17 (d) and 3.02.01 the respectfully petitions the Board of Garfield County, Colorado to exempt and amended April 14, 1975, undersigned, Dan Kerst, County Commissioners of by resolution the division of that tract of land containing thirty-five (35) acres, more or less, described on Exhibit "A" attached hereto and incorporated herein by this reference into two tracts containing approximately 6.5 acres acres each, and one tract containing approximately 23 acres as depicted on Exhibit "B" attached hereto and incorporated herein by this reference, from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. 1973 Section 30-28-101 (a) -(d) and the Garfield County subdivision regulations, and in support thereof states:. 1. That the requested division of the subject property is consistent with the parcels. 2. The subject property lies totally Colorado. current lot size and configuration of adjoining • within Garfield County, 3. Petitioner believes that a permit for an adjudication of a domestic water well can be obtained for the supply of domestic water to each of the divided tracts. Petitioner further believes that a suitable individual septic system can be utilized to serve each tract. 4. Petitioner submits that the division of the above described property as requested is responsive to the public need for additional developable residential lots with adequate water supply • s in Garfield County. 5. The proposed tracts will have adequate access from County Road 335. Petitioner submits the fee in the sum $85.00 in connection with this petition. The developer proposes to use wel is for the water supply which would intercept ground water tributary to the Colorado River at a point where there is still water available for appropriation.
