PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned LEE ANN
EU ST I S respectfully petitioners the
Board of County Commissioners of Garfield County, Colorado, to exempt by resolu-
tion the division of a 60 acre tract of land into 4 tracts of
approximately
15 acres each, more or less, from the difinitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: only 3 new lots being created with the
remainder of property being the 4th lot. Purpose is to build new
house on 1 lot and develope 2 lots -for children. Property has been
in same ownership for over 5 years.
In support of this petition, the petitioner also submits the following:
(a) Map drawn to scale showing proposed lot
subdivision and access
(b) Copy of deed
(c) Vicinity Map
(d) State on source of domestic water
(e) Statement on method of sewage disposal
f 100 year floodplain information where
live stream crosses or adjoins said tract

STATEMENT ON SOURCE OF DOMESTIC WATER
AND METHOD OF SEWAGE DISPOSAL
No central water systems currently exist near the subject
property. It is proposed that the four tracts will be served by
an existing domestic well. The petitoner has a decreed water
right for .033 cfs for domestic purposes from Brock Well. The
well has an appropiation date of October 1969 -- see Decree and
Ruling (Case #1865) attached hereto. For the location of the
Brock Well and existing water system, see the Exemption Map
attached to this application.
The present water system for the existing dwelling on
proposed Tract 1, consists of the previously described Brock
Well located on the lower portion of the sixty acres, on
proposed Tract 4. In addition, a 2" pipeline, as shown on the
Exemption Map, runs along the easterly sides of proposed Tracts
3 and 4 northward through Tract 2 and looping around the ridge
to an existing 2,000 gallon storage tank on proposed Tract 1.
In consultation with Miles Holub, the designer of the original
system, the addition of a pressure reducing valve for Tract 4
and one inch service lines to all sites with curb boxes
installed where taps are made to the main line will be required.
All dwellings would also be required to install water meters and
unless the applicant obtains an exemption from the State on

water quality, a small clorinating system will be installed at
the pump site. If additional storage is ever needed, it would
be placed adjacent to the existing tank.
.033 cfs calculates to approximately 15 GPM, an adequate
supply for domestic use for four dwelling units (see letter from
Samuelson Pump Co., attached hereto). One fourth of the rights
from the Brock Well owned by the Petitioner, will be conveyed to
the purchase of each tract for their use.
As to the method of sewage disposal, assurances are given
that individual treatment systems will be developed on each new
developed tract as approved by the Garfield County Health
Officer and in compliance with State and local regulations.

Atten: Mrs Eustis
On January 12, 1981 a well test was performed on a well located
on the Eustis property at 3677 103 rd. The following information
was obtained:
Well Depth 260'-0"
Standing water level 123'-1"
Total test time at 15 gpm. 4 hrs
Maximum draw down after 4 hrs123'-1"
Production is greater than 15 gpm
This test was conducted with the existing 1 1/2 hp. Sta-Rite
submersible pump Model 8P. and existing equipment. The maximum
pumping rate with the existing pump over the well head is 15 gpm.
This test indicated that the well has sufficient production to
supply an addition°:4 residences. This system is set up to deliver
water from the well to a storage tank near the existing residence.

We have reviewed the above referenced applications for exemption.
The wells proposed as the water supply would intercept ground water
which is tributary to Cattle Creek, and over -appropriated stream. Since
new wells could cause the injury to senior vested water rights, well
permits cannot be issued by this office and we cannot recommend approval
of these proposals.

Dear Ms. Eustis:
On April 20, 1981, the County Commissioners passed a resolution
requiring a $200 per lot assessment for schools for all new lots
created through the Senate Bill 35 Subdivision Exemption process.
This is applicable to all new parcels created by exemption. The
requirement is applicable to all pending exemptions, as well as
all exemption requests initiated after the April 20, 1981 date.
You will therefore be required to submit $200 for every new lot
that was authorized by your currently pending exemption.

Re: Lee Ann Eustis - Application for Subdivision Exemption
Dear Davis:
As you know, on April 6, 1981, the County Commissioners consi-
dered Mrs. Eustis' Exemption Application at a continued hearing
from a previous date. I attended and made certain arguments, and
the County Commissioners moved to extend the hearing further to
April 27 at 1:45 P.M.
It was my understanding that the Commissioners stated that
they would consider this matter informally within a few days after
the April 6th hearing to decide whether or not they were going to
give further consideration to the four lot application now filed
and render a decision on that on April 27th. If not, they were to
notify me that Mrs. Eustis should file a new Application for a
three lot exemption.
This letter is simply to remind you that I would appreciate
a call if anything further is needed to be filed before the April
27th hearing date.

Dear Davis:
In accordance with the Garfield County regulations for
exemption from the County Subdivision regulations, I submit
on behalf of Lee Ann Eustis, Petitioner, for your considera-
tion, five copies of a Petition for Exemption and related
material. Also attached, is an application fee in the
amount of $110.00. Evidence of soil types are not included
with this application as Soil Surveys prepared by the U. S.
Soil Conservation Service for this area are not available at
this time. They were requested on November 29th, 1980 and
will be submitted as soon as they are available. For
clarification, please contact Stanley Woodyard of the S.C.S.
Office in Glenwood Springs.
The subject tract, shown on the Vicinity Map and
described on two deeds which are attached, consists of sixty
acres with an existing dwelling and is proposed to create
three new tracts. These three new tracts are proposed to be
created for the purpose of the owner building a smaller new
house on one of the new tracts, deeding two tracts to the
applicants children with the existing house being on the
fourth tract.
You have previously advised the Applicant by letter
dated November 17th, 1980, that this plan fell within the
requirments for an Exemption. Please advise me of the date
and time this matter will be heard before the Garfield Board
of County Commissioners. Thank you for your consideration
in this matter.
