I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District F, Rural Areas with Severe
Environmental Constraints of the Garfield County Comprehensive Plan
Management District Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site DescriEtion: The site has moderate slopes with various
native vegetation, in addition to lawns and gardens. Two
existing dwellings are located on site, one on each of the
proposed lots, surrounding land uses are mainly single family
dwellings and open space.
B. Project Description: The applicant proposes to create two
parcels of 4.4 acres in size out of the original 8.8 acre tract.
Both proposed tracts have all required utilities in place.
III.MAJOR ISSUES AND CONCERNS
1. Two additional 2 acre lots were created by exemption on this site
in 1977, approved by Resolution #77-108. The proposed exemption
would be the final one allowed on this site based on Garfield
County Subdivision Regulations Exemption Review Criteria.
2. Each proposed lot should receive a deeded interest of at least 5
GPM in the existing spring to assure a continued legal and
adequate source of water. In addition, easements for waterlines
and access and maintenance of the spring should be included on
the exemption plat and in any legal descriptions.
3. Access easements for the existing private drive should be shown
on the exemption plat and included in any legal descriptions.

IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as required
for the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the nest interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1 . That a plat note be included on the Exemption Plat stating "No
further divisions oy exemption from definition will be allowed".
2. That the following be included on the Exemption Plat and in any
legal descriptions:
A. Easements for all waterlines, and access and maintenance of
the existing spring.
B. Access easements for the existing private drive.
3. That each parcel receive a deeded interest in the existing spring
of at least 5 GPM.

5. All representations of the applicant, either with the application
, or stated at the hearing before the Board of County
Commissioners, shall be considered conditions of approval.
