PETITION FOR EXE MPTION
Pursuant to C.R.S. (1973) Section 30 -28-lOl(lO)(a) -(d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1 .02.17(d) and
3.02.01, the undersigned Charles L. an d Roberta s . E ricksor:i
respectfully petitions the Board of County Corrunissioners of Garfield
County, Colorado, to exempt by resolution A tract of l an d located in
portions of Lots 2 and 3, Section 14, T7 S . R. 88 w., 6th P.M. ·
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-lOl(a) -(d) and the Garfield County Subdivision Regulations,
for the reasons stated below: said prope r ty is more p rop erly us e d f or
two families than for a sin g le family an d is t opog r aphi c all y s u i te d the re t o,
it has access for both parts on an a cces s roadway , has pow er and telep hon e
available, has been approved for sep tic s ervic e by Ga r fi e l d County, and h as
g ood wells immediatly adjoining. Said prop erty i s to be sold to a p a rty
desirous of building his own residence and a residence for his i n-laws.
Property will be s p lit along a pp roximate lines shown on attache d p lat

Beginning at a point whence the West ~ corner of said Section 14 bears:
s. 84°06'41• w. 1398.87 feet; thence N. 72°52'46" E. 340.81 feet;
thence s. 00°03'30• B. 860.26 feet; thenca N. 54°27'l5n W. 40 0.73 feet;
thence N. 00°03•30• W .. 526.96 feet to the point of beginning.
Together with a roadway easement 30 feet in t-.iidth for purposes of
ingress and egress, to be used jointly by granters and grantees their
heir, successors and assigns, over and across grantor's property, North
of and adjacent to the above described property along an existing
roadway 30 feet in width and parallel to the East line of grantor's
property from the County Highway to the North line of the above des-

Re: Letter of Fe asibility for Sewage Di sposal for SB-35 Exemption requested
for Charles L. Erickson & Roberta S. Erickson -A tract of land located in
portions of Lot 2 and Lot 3, Sec. 14, T.7S.,R.88W.,6th P.M.
Gentlemen:
Based on the information received by this office and past experience with
sewage disposal facilities in the im nedi ate area of the proposed exemption, it
has been determined by this office on-lot sev1age disposal facilities are both
feasible and practical, commensurate with both County and State regulations,
provided proper permits are obtained prior to construction.
It should be further noted that due to the known con ditions, only the follow-
ing types of on-lot sewage disposal systems would be acceptable:
x Approved septic tank and absorption area
x Approved septic tank and dry we 11
x Approved aerated treatment unit an d absorption area
Approved aerated treatment unit and sealed sub-surface
evapotranspiration system
