S -6' BOUK55 12 PAGE 5 WHEREAS, Dennis Erickson has petitioned theBoard of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 9.5 acre tract into two (2) tracts of approximately 4.5 and 5 acres, more or less, and said 9..5 acre tract is more particularly described as follows: Parcels of land situated in Lot 1 of Section 14, Township 7 South, Range 88 West of the Sixth Principal Meridian, lying Northerly of the Northerly right-of-way line of a County Road as constructed and in place, said parcels being described as follows: Parcel A. Beginning at a point on Northerly right-of-way line of County Road, point being on the Westerly boundary of that certain tract of land purchased from the Carbondale Land and Development Company by Homer Chapman; thence N.00°03'30" W. 508.65 feet along the Westerly boundary of said tract: thence S.63°39'04" E. 565.0a feet to a point on the Northerly line of said tract purchased by Homer Chapman; thence S.26°20'56" W. 437.00 feet, more or less, along the Easterly line of said tract to a point on the Northerly right-of-way line of said County Road; thence N.59°15'00" W. 36 feet, along the Northerly right-of-way line of said County Road; thence 158.85 feet along the arc of a curve to the left, having a radius of 460.84 feet, the chord of which bears: N.69°07130" W. 158.07 feet; thence 113.74 feet along the arcof a curve to the righ, having a radius of 329.01 feet, the chord of which bears: N.69'05'47" W. 113.17 feet; thence N. 59°11'34" W. 30.71 feet along the Northerly right-of-way line of said County Road to a point on the. Westerly boundary of said tract, the point of beginning. The above parcel of land contains 4.50 acres, more or less. Parcel B. Commencing at the West quarter corner of said Section 14; thence N. 26°04'37" E. 1954.35 feet, said point being on the Northerly right-of-way line of said County Road, said point being on the Westerly boundary line of that certain tract of land purchased by Homer Chapman from the Carbondale Land and Development Company; thence N.00°03'30" .W. 508.65 feet along the Westerly boundary line of said tract; thence S. 63°39'04" E. 565.00 feet to a point on the Northerly line of said tract, the true point of beginning of Parcel "B"; thence S. 63039'04 E. 391.36 feet, to the northeast corner of that certain tract of land purchased by Horner Chapman from the Carbondale Land and Development Company; thence S.00°03'30" E. 498.47 feet along the Easterly line of said tract to a point on the Northerly right-of-way line of said County Road; thence 284.20 feet along the arc of a curve to the left, having a radius of 590.50 feet, the chord of which bears N.57°17'43" W. 281.46 feet; thence N. 71°05'00" W. 104.00 feet along the Northerly right-of- way line of said County Road; thence 232.95 feet along the arc of a curve to the right, having a radius of 1127.92 feet the chord bears N. 65°10'00" W. 232.54 feet; thence N.26020'56" E. 437.0 feet, more or less, to the Northerly line of said tracts, the true point of beginning. The above described parcel of land contains 5.00 acres, more or less. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage; and, BUUK5 12 PAGE 583 WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that here is a reasonable probability of locating domestic water on each the said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended; NOW THERFORE, upon motion of --4(Z! , 0,C1(1.50_,seconded by, .e..J0(1 and carried, said 9.5 acre tract of land is hereby exempted from such definition adn transfer of said tract may be made by division into two (2) tracts of 4.5 and 5 acres, more or less, all as is more fully described above, and further that said exemption is conditioned upon the Petitioner obtaining a proper legal description of said tracts prior to any conveyance thereof. This exemption is granted upon the condition that no further exemptions be allowed on said tracts of land. A copy of the instruments of conveyance when recorded shall be filed with this Resolution.
