when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 82-128
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION
REGULATIONS FOR JOAN DUPREY.
WHEREAS, Joan Duprey has petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption from the definition of the terms "subdivision" and
"subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections
2.02.21 (d) and 3.02.01 for the division of a 15 acre tract described as follows:
that parcel of land as described in Document No. 254635 as filed in the Office of
the Clerk and Recorder of Garfield County, Colorado into.2 tracts of approximately .7
acres and the remaining 14.3 acres each, more or less, which proposed divided tracts
are more particularly described as follows:
TRACT A: All that portion of the West Half of the Southwest Quarter of Section Thirty -
Four, Township Five South,Range Eighty -Nine West of the Sixth Principal
Meridian, described as follows:
Beginning at a point which bears N.0°06'W a distance of 1211.90 feet from
the Southerly Section Corner common to Sections 33 and 34, Township 5 South
Range 89 West, 6th Principal Meridian', thence N.0°06'W along the Section

of intersection of said Section Line and the North Line of the Access
Road; thence N.89°50'E a distance of 174.24 feet to the Centerline of the
County Road; thence S.27°32'45"W. along said ;;ounty Road a distance of
139.06 feet; thence S.21°56'41"W. along said County Road 146.21 feet; thence
S.25°06'28"W. along said County Road a distance of 128.76 feet to the True
Point of Beginning. Except the County Road along the Southeasterly boundary
of the property above described.
TRACT B: All that portion of the West Half of the Southwest Quarter (W1/2SW4) of
Section Thirty Four (34), Township Five (5) South, Range Eighty -Nine
(89) West of the Sixth Principal Meridian (6th P.M.) described as
follows:
Beginning at a point which bears N.0°06'W. 1586.90 feet from the Southerly
Section Corner common to Sections 33 and 34, Township 5 South, Range 89West
of the 6th Principal Meridian, thence N.0°06'W. 1049.63 feet to the
Quarter Corner common to said Section 33 and 34; thence N.89°50'E.
621.3 feet to the centerline of the County Road; thence S.14°26'W. 397.0
feet along said Centerline; thence S.27°27'18"W. 751.05 feet along said
centerline; thence S.89°50'00"W. 174.24 feet along the north line of an
access road to the point of beginning. Except the County Road along
the Southeasterly boundary of the property above described.

WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that the proposed division does
not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised
Statutes 1973, as amended, for the reason that the split is solely for the purposes
of adjusting boundaries, and no new lots are created, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability
of locating domestic water on each of said tracts, that there is adequate ingress
and egress to said tracts, that the location of septic tanks will be permitted by
the Colorado Department of Health, that the requested division is not part of an
e ir,ting or larger development and does not fall within the general purposes and
intent of the subdivision regulations of the State of Colorado and the County of

Garfield, and should, ti'erefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in the C.R.S. 1973, 30-28-101
(10) (a) -(d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts
"A" and "B" from the above described 15 acre tract is hereby exempted from such
definitions and said tract may be divided into tracts "A" and "B", all as is more
fully described above, and said divided tract may be conveyed in the form of such
smaller tracts without further compliance with the aforesaid subdivision statutes
and regulations ; and that a copy of the instrument or instruments of conveyance
when recorded shall be filed with this Resolution.
