HomeMy WebLinkAbout2.0 Resolution 77-7RESOLUTION 77-7 WHEREAS, RALPH A. EARNEST and VIRGINIA EARNEST have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101(10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 1.71 acre tract, more or less, into two (2) tracts of 1.00 and .71 acres, more or less, and more particularly described as follows: PARCEL A A parcel of land situated in the SW1/4SE4 of Section 16, T. 6 S., R. 89 W of the 6th P.M., in Garfield County, Colorado, more particularly described as beginning at a point in the center of the Roaring Fork River, whence the Northeast Corner of the SEq of said Section 16 bears N. 520 14' 24" E. 2,399.42 feet; thence N. 88° 34' W. 299.10 feet, more or less, to a point on the Easterly boundary line of Midland Avenue; thence along such Easterly boundary line of Midland Avenue, N. 10° 49' W. 78.30 feet, more or less; thence along said Easterly boundary line of Midland Avenue, N. 05° 14' 58" W. 23.60 feet, more or less; thence S. 880 34'_E. 321.13 feet, more or less, to a point in the center of the Roaring Fork River; thence along the center of the Roaring Fork River, S. 030 03' W. 100.00 feet, more or less, to a point in the center of the Roaring Fork River, being the point of beginning, containing 0.71 of an acre, more or less. PARCEL B A tract of land situated in the WZSEn of Section 16, Township 6 South, Range 89 West of the 6th Principal Mer- idian, Garfield County, Colorado, lying Westerly of the centerline of the Roaring Fork River and Easterly of a road as constructed and in place, described as follows: Beginning at a point in the center of said river whence an iron post with a brass cap properly marked for the East Quarter Corner of said Section 16 bears N. 54° 06' E. 2335.40 feet; thence N. 880 34' W. 321.13 feet to a point on the Easterly line of said road; thence N. 050 14' 58" W. 133.82 feet along the Easterly line of said road; thence S. 880 34' E. 340.14 feet to a point in the center of said river and thence S. 020 54' 54" W. 132.96 feet along the centerline of said river to the point of beginning, and containing 1.00 acre, more or less. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of providing access to the adjoining lot and that the undeveloped .71.acre parcel will not create a third -party ownership or additional building site, and; WHEREAS, Petitioners have demonstrated to the satisfaction of the Board that there is adequate ingress and egress to said tracts, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and should therefore, be exempted from the definition of the terms "subdivision". and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) (d) as amended; NOW THEREFORE, upon motion of. ,._ seconded by ,,y,y , and carried unanimously, said 1.71 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two (2) tracts of 1.00 and .71 acres, more or less, all as is more fully described above, and further that said .71 acre lot is for the purpose of providing access to the adjoining lot and will not create a third -party ownership or constitute a separate building site. A copy of the instrument or instruments of conveyance when recorded, shall be filed with this Resolution. Dated.this day of January, A.D. 1977.
