PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the Definition
of subdivision.
APPLICANT: Daniel and Gretchen Dumas
LOCATION:
A parcel of land in the SE 1/4
SW 1/4 of Section 14, T7S, R93W
of the 6th P.M.; located
roughly ten (10) miles south of
Rifle on C.R. 319.
SITE DATA: The property consists of 84
acres.
WATER: Existing and proposed
individual wells.
SEWER: Existing and proposed I.S.D.S.
ACCESS: Access off C.R. 319.
EXISTING ANI) ADJACENT ZONING: A/R/RD
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District C - Rural Areas
with Minor Environmental Constraints as designated on the
Garfield County Comprehensive Plan Management District's map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located in a rural portion
of the County with adjacent land uses consisting of
agriculture and open space. The property is split by the
county road. Improvements on the property include a log
home, an abandoned frame house, a barn and an
outbuildings.
B. Project Description: The applicants are proposing to
split the 3.84 acre portion of the property with the
improvements, on the north side of the county road, from
the remaining 80 acres located on the south side of the
roadway. The purpose for the split is "to allow the
owners to refinance the existing short-term mortgage
which encumbers the entire 84.09 acres by obtaining a
long-term loan. Lenders are reluctant to finance such a
large tract. Therefore, owners wish to divide acreage so
that they may obtain a new loan encumbering the 3.84
acres and all improvements . "
I]:I. MAJOR IISSUES AND CONCERNS
1. Although the applicants have no intention of selling the
separate interests at present, the exemption process is
warranted because one of the parcels is less than 35
acres in size.

2. There are existing utilities in place on the smaller
parcel. The Division of Water Resources has indicated
(see letter on page 9 ) that they would issue a
domestic well permit for the 80 acre parcel.
3. Soils information indicates that there are no particular
problems with homesite development and waste water
systems.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as
required by law for the meeting before the Board of
County Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested
parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That all representations of the applicant, either within
the application or stated at the meeting before the Board
of County Commissioners, shall be considered conditions
of approval.
2. That the applicants shall comply with all conditions of
approval and submit an Exemption Plat within 120 days of
Board of County Commissioners approval unless an
extension of approval is granted by the Board of County
Commissioners prior to the expiration of the 120 day time
limit.
3. That the following plat note be included on the Exemption
Plat:
"USFS and Colorado State

4. That the applicant submit $200 in School Impact Fees for
the creation of the new lot prior to the approval of the
Exemption Plat.
5. That the applicant or future lot owner obtain a Driveway
Access Permit from the Road and Bridge Department prior
to obtaining a Building Permit.

Dear Mr. McGregor:
We have reviewed the above referenced proposal to divide an 84 acre tract
into parcels of 80.25 and 3.84 acres. There is an existing house and well on
the proposed 3.84 acre parcel. It appears that this well was constructed
under Permit Number 60881. If this is the case, we have no objection to this
proposal. The availability of a well on the remaining 80.25 acres will be the
same as any tract over 35 acres.
