RESOLUTION NO.80-148
RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM
THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR
LORIN DOOLIN
WHEREAS, Lorin Doolin has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the terms
"subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d),
as amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a
4.5 acre tract described as follows: in Book 402, Page 182 in the Office of
the Clerk and Recorder of Garfield County, Colorado and beginning at a point on
the South, line of the SE4NE4 of Section 6, Township 6 South, Range 91 West of
the 6th P.M. from thence the SE corner of SE4NE4 bears N.88°40'49" East 268.61
feet; thence along the High Line Ditch the following courses and distances:
N.64022'00"W. 106.59 feet; thence N.09°51'00" E. 91.23 feet; thence N.07004'00
W. 86.45 feet; thence N.21°24'00 W. 39.25 feet; thence S.49°21'00" W. 89.39
feet; thence,.S.81°39'00" W. 51.76 feet; thence S.21°21'00" W. 78.70 feet; thence
N.37°32'00" W. 209.00 feet; thence N.55°00'00" W. 156.90 feet; thence N.35°09'00
W. 67.92 feet; thence N.01°45'00" E. 33.02 feet; thence N.17°35'00 E. 133.04
feet; thence N.13°07'00 E. 30.50 feet; thence 5.89°42100" W. 101.65 feet;
thence`S.57°07'00" W. 85.44 feet; thence S.13°09'00" W. 56.85 feet; thence
S.16°38'00" W. 133.53 feet; thence S.24°51'00" E. 214.35 feet; thence S.41°28'00"
E. 127.34 feet; thence S.35°24'00" E. 135.93 feet, more or less to a point on
the Southerly line of said SE1/4NE4 thence East along said South line to the point
of beginning into 2 tracts of approximately 2.25 and 2.25 acres each, more or
less, which proposed divided tract is more particularly described as follows:
Tract A: A tract of land in the Southeast 1/4 of the Northeast
1/4 of Section 6, Township 6 South, Range 91 West of the Sixth
Principal Meridian described as follows:
Beginning at the East 1/4 corner of said Section 6, thence
South 88°40'49" West a distance of 740.12 feet along the South
line of the said Northeast 1/4 of Section 6 to a point on the
HighLine Ditch; thence North 35°24'00" West a distance of
135.93 feet along the High Line Ditch to the true point of
beginning; thence along the High Line Ditch the following courses
and distances: N.41°28'00" W. 127.34 feet; thence N.24°51'00" W.
214.35 feet; thence N.16°38'00" E. 133.53 feet; thence N. 13°09'00"
E. 56.85 feet; thence N.57°07'00" E. 85.44 feet; thence N.89°42'00"
E. 101.65 feet; thence S.13°07'00" W. 30.50 feet; thence S. 17°
35'08" W. 133.04 feet; thence S.01°45100" W. 33.02 feet; thence
S.35 09'00" E. 67.92 feet; thence S.55000'00" E. 135.00 feet;
thence leaving the High Line Ditch S.37°30'41" W. a distance of
249.17 feet more or less to a point on the High Line Ditch, said
point being the point of beginning; containing 2.03 acres more or
less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that the proposed division
does not fall within the purposes of Part 1, Article 28, Title 30, Colorado
Revised Statutes 1973, as amended, for the reason that the impact created is not
great enough to warrant a full subdivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board

of County Commissioners of Garfield County, Colorado, that there is a reasonable
probability of locating domestic water on each of said tracts, that there is
adequate ingress and egress to said tracts, that the location of septic tanks
will be permitted by the Colorado Department of Health, that the requested
division is not part of an existing or larger development and does not fall
within the general purposes and intent of the subdivision regulations of the
State of Colorado and the County of Garfield, and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended,
NOW, THEREFORE, BE IT RESOLVED that the division of the above described
tract "A" from the above described 4.5 acre tract is hereby exempted from such
definitions and said tract may be divided into tract "A", all as is more fully
described above, and said divided tract may be conveyed in the form of such
smaller tracts without further compliance with the aforesaid subdivision statutes
and regulations; provided, however, that this exemption is granted on the condi-
tion and with the express understanding and agreement of the Petitioner that no
further exemptions be allowed on said tract "A", and that a copy of the instru-
ment or instruments of conveyance when recorded shall be filed with this
Resolution.
