PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, CoIorado, adopted
September l, 1972 and amended April 14, 1975, Sections I .02.17(d) and
3.02.01, the undersigne d John Doremus a ent for Divide Creek Joint
enture,
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by reso'lution the division of L72 acre
ranch into 5 tracts (4.35 AC+ and 1-18AC) located in Sec. '
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terrm are used and defined in C.R.S. (1973)
Section 30-28-10l(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated be]ow:
It is the intention of the Petitioner to divide the subjectproperty into 5 parcels for sale for single family residentialpurDoses. The ranqh and plan of divisiqn is ghown on the at-tached'p1at. The 5 parcels are identified as 1 through 5. ThePetitioner is unable to, proceed with the division and sale ofparcel 5, which is approximately 18 acres, without the permissionof the Board of County Commissioners.

Re: Doremus Exemption
Dear Mr. Witkowski
This is to acknowledge receipt of information pertaining to the
above referenced exemption which consists of 4 tracts in excess of 35
acres and I tract of IB acres. In that the owners of tracts greater than
35 acres are entitled to have a domestic well for a water supply, the
only tract to be considered is the one additional l8-acre tract. This
office would issue a household use only well permit (no lawn or garden
irrigation) to the purchaserof this tract.
