RESOLUTION NO. 78 -

J. Randy wilson, has petitioned the .Boand of county commissioner"s
of'Ganfield cor:nty, colorado fon an exemption fnom the definition

l-973, 30-28-101 (10) (a)*(d) as amended, and the subdivision
Regulations of Ganfield county, color-ad.o, a<lopted September 1, 1972
and amended Ap,il 14, 1975, sections t.o2.t7 (d) and 3.02.01, for
the division of a 16.35 aine tnact into two (2) tr.acts of approxi-
rately 8.175 acres each (her:einaften tnacts rtA, and,Brr), more or

WI{EREAS, the Petitionen has demonstnated to the satisfaction of
the Board of County Commissionens of Garfield County, Colonado, that
he desi::es said exemption fon the purpose of nesal-e of said'tnacts
rrAtt and ItBn into single-family nesidential acreage, and. I
WIIEREAS, the Petitionen has not demonstnated to the. satisfaction
of the Boand of County Commissioners'of Ganfield County, Colonado,
that said exemption is in accondance with the general punposes and
intent of the Subdivision Regulations of the State of Colonado and
the County of Garfield, and;
WHEREAS, said 16.35 acre tract contains slopes in excess of
50 pencent, and said tnact has been granted only one water tap by
the Rivenview Subdivision, and access to said tract is to be pr^ovided
by a steep private noad, said 16.35 acre tract is deemed unsuitable
fon furthen subdivision;
NOW, THEREFORE, upon the motion of Richa::d C. Jol1ey,
seconded by Flaven J. Cenise, and carrnied, said exemption nequest-
fon Richard S. Cutlen, Jn. is hereby denied and transfer of said

16.35 acne tract of land shall not be conveyed in the form of such
smallen tracts except persuant to full compliarrce with the Subdivision
Regulations of the state of cororado and the county of c,anfield.
