a colorado corporation, respectfulry petitions the Board of
county commissioners of Garfield county, colorado, to exempt
byResolutionthedivisionofaforty.one(41)acretractof

defined in C.R.S' (r9?3) Section 30-28-fO1(10) (a) - (d) and the

below:
S TATEMENT OF REASONS
Exclusion of the forty-one acre tract of land (the
,,property,,) on which cogeneration Technology and Development
Company(uCTDC',)isdevelopingacogenerationfacilityfrom
the Garfield county subdivision Regulations (the "subdivision
RegulationS',)willnotbedetrimentaltothegeneralpublic
welfare nor will it impair or defeat the stated purposes of
theSubdivisionRegulations.Thefacilitywillgenerate
electrical power and then use the exces heat from power
generationtooperateaten.acregreenhouse.cTDcintendsto
operatethepowergenerationfacilitybutanunaffiliated
third-Party wiII operate the greenhouse pursuant to a long-
term Iease. However, the greenhouse and power generation
facility are part of a single project' Separate operation of
the greenhouse portion of the facility will not result in any
additional construction or development and the power
generationfacilityandgreenhousewillbestructurallyand
operationallY integrated'

BecausethePowergenerationfacilityandgreenhouse
are part of one unified project' CTDC believes that the
Property may not be subject to the Subdivision Regulations'
However, CTDC is applying for an exemption from the
SubdivisionRegulationsaSaprecautionintheeventthatt.he
long-term lease and separate ownership of a leasehold estate
covering the greenhouse should trigger application of the
Subdivision Regulations'
The power generation facility and greenhouse wiII
utilizethesameStreetsandroads,theSamewaEersupplyand
the same fire protection plan' AII Garfield County zoning
requirements will be met' the Property wiIl have legal access
toapublicright-of-way,andprovisionshavebeenmadeforan
adequate source of water for the entire project in terms of
both the regar and physicar quarity, quantity and
dependability,andforsuitableSewagedisposalfortheentire
facility.Allstateandlocalenvironmentalhealthandsafety
requirementshavebeenmetorareintheprocessofbeingmet,
provision has been made for any required road or storm
drainageimprovementsandanyneceSsarydrainage,irrigation
orutilityeasementshavebeenobtainedorareintheprocess
of being obtained' rn addition' the power generation facility
and greenhouse are cornplimentary in their land and natural
resourceuseSandtogetherwillfosterbothagriculturaland
non-agricultural use of the Property'
Exemption of the Property from the Subdivison
Regulations will not be detrimental to the residents of

orderly fashion as a singre project, encompassing the entire
