BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLQRADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973 30-28-101, and the Garfield County Subdivision
Regulations, the undersigned, F.M. CROSS, respectfully petitions the Board of
County Commissioners of Garfield County, Colorado, to exempt by resolution the
division of property described on the attached sketch plan, from the definition
of the term "subdivision" "subdivided land" as the same are used and defined
in C.R.S. 1973 30-28-101, and the Garfield County Subdivision Regulations.
The property to be divided is described as follows:
A parcel of land located in the SE4 of Section 36,
Tp. 5 S., R. 93 W., 6th P.M., described as follows:
Commencing at the SE corner of said Section 36;
thence N. 89° 25' W. 628.57 feet to the true point
of beginning and the Westerlx ROW fence of State
Highway No. 13; thence N. 89 30' W. along a fence
running Westerly from said highway fence 1021.45
feet; thence North 1320.00 feet; thence S. 89° 28'
E. 330.00 feet; thence N. 00°01'30" W. 107.77 feet;
thence East 811.66 feet to the Westerly ROW fence
of said highway; thence S. 00° 44' W. along said fence
799.27 feet to a point of curvature to the right;
thence continuing along said fence whose chord bears
S. 09°50' W. 643.86 feet (said fence being 22.4
feet Easterly of the chord at its mid -point) to the
point of beginning.
Your petitioner entered into a lease and option agreement in February, 1974,
with his daughter and son-in-law, LARRY ROHRIG and MARY CATHERINE ROHRIG, to
sell to them the South ten acres of this parcel.
This property is located on Colorado Highway 13, approximately two miles
North of Rifle, Colorado. As originally purchased by your petitioner, the
parcel contained more than thirty-five acres. Since his purchase of the property,
your petitioner has not requested, and does not intend to request, any additionajl
exemptions from the subdivision regulations.
Access to this property is directly on to Colorado Highway 13. Public
Service natural gas and electricity, and Mountain Bell telephone, serve adjacent
parcels,
and lines therefor intersect the property. Several other homes in
'this vicinity have successfully obtained water by well drilling, and have
(disposed of sewage by conventional means.

There are no improvements on either parcelat this time.
