HomeMy WebLinkAbout2.0 Resolution 77-6RESOLUTION 4k% %— () WHEREAS, F.M. CROSS has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 35.79 acre tract of land into two (2) tracts of approximately 25.79 acres and 10.00 acres, more or less, and more particularly described as follows: A parcel of land located in the SEQ of Section 36, Tp. 5 S. R 93 W., 6th P.M., described as follows: Commencing at the SE corner of said Section 36; thence N. 89° 25' W. 628.57 feet to the true point of beginning and the Westerly ROW fence of State Highway No. 13; thence N. 89u 30' W. along a fence running Westerly from said highway fence 1021.45 feet; thence North 1320.00 feet; thence S. 890 28' E. 330.00 feet; thence N. 000 01' 30" W. 107.77 feet; thence East 811.66 feet to the Westerly ROW fence of said highway; thence S. 00° 44' W. along said fence 799.27 feet to a point of curvature to the right; thence continuing along said fence whose chord bears S. 09° 50' W. 643.86 feet (said fence being 22.4 feet Easterly of the chord at its mid- point) to the point of beginning. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and that said division will actually restrict the density of housing within said area and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of '�1; th L'.1,1-.7(1,;?:,- ! U -L , seconded by .'CLL ^,t- t ti_ c , and carried said 35.79 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two (2) tracts of 25.79 and 10.00 acres, more or less, all as is more fully described above, and further, that a permit for access off of Highway 13 be obtained from the State Department of Highways. A copy of this instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this /, day of January, A.D. 1977.
