Cerise Earl Rhodes Mildred Alsdorf , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 83-122 WHEREAS, Robert L. DeRoeck and Glennyce R. DeRoeck and Joe Jammaron have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for for purpose of a boundary line adjustment for those parcels of land as described in Book 608, Page 640 and 641 and Book 506, Page 469 and 470 as filed in the office of the Clerk and Recorder of Garfield County, Colorado. The adjusted tracts of land are more particularly described as follows: Tract A: The parcel owned by Robert and Glennyce DeRoeck as shown in Book 608, Page 640 and 641 with the addition of a parcel of land situtated in Lot 18, Section 35, Township 6 South, Range 89 West of the Sixth Principal Me =idian, County of Garfield, State of Colorado; said parcel being more particularly described as follows: Commencing uL the Southeast Corner cf .^aid Lot 18, a reher ^ap in place, the True Point of Beginning; tnence S. (-.)6°20'06" --..,,,y the south line of said Lot 18, 261.03 feet; thence leaving said south line N. 29°29'00" E. 160.47 feet to a point on the southerly right-of-way line of County Road No 154; thence S. 60°31'00" E. along said right-of-way line 210.26 feet to a point on the east line of said Lot 18, a rebar and cap in place; thence leaving said right-of-way line S. 04°25'58" W. along the east line of said Lot 18, 19.57 feet to the True Point of Beginning; containing 0.45 acres, more of less, and the deletion of a parcel of land situated on Lot 27, Section 35, Township 6 South, Range 89 West of the Sixth Principal Meridian, County of Garfield, State of Colorado; said parcel being more particularly described as follows: Commencing at the Northeast Corner of said Lot 27, a rebar and cap in place; thence S. 86°20'06" W. along the north line of said Lot 27, 261.03 feet to the True Point of Beginning; thence leaving said north line S. 29° 29'00" W. 197.63 feet to a point on the centerline of the Roaring Fork River; thence N. 75°39'12" W. along .said centerline 242.78 feet; thence N. 82°09'22" W. along said centerline 237.65 feet; thence leaving said centerline N. 00°08'00" W. 43.07 feet to a point on the north line of said Lot 27; thence N. 86°20'06" E. along said north line 569.17 feet to the True Point of Beginning; containing 1.24 acres,,more or less. Tract B: The parcel owned by Joe Jarnmaron in Book 506, Page 469 and 470 with the addition of a parcel of land situtated in Lot 27, Section 35, Township 6 South, Range 89 West of the Sixth Principal Meridian, County of Garfield, State of Colorado; said parcel being more particularly described as follows: Commencing at the Northeast Corner of said Lot 27, a rebar and cap in place; thence S. 86°20'06" W. along the north line of said Lot 27, 261.03 feet to the True Point of Beginning; thence leaving said north line S. 29°29'00" W. 197.63 feet to a point on the centerline of the :.oaring Fork River; thence N. 75°39'12" W. along said centerline 242.78 feet; thence N. 82°09'22" W. along said centerline 237,65 feet; thence leaving said centerline N. 00°08'00" W. 43.07 feet to a point on the north like of said LoL. 27; thence N. 86°20'06" E. along said north line 569.17 feet to the True Point of Beginning; containing 1.24 acres, more or less, and the deletion cf a parcel of land situated in Lot 18, Section 35, Township 6 South, Range 89 West of the Sixth Principal Meridian, County Road Garfield, State of Colorado; said parcel being more particularly described as follows: Commencing at the Southeast Corner of said Lot 18, a rebar and cap in place, the True Point of Beginning; thence S. 86°20'06" W. along the south line of said Lot 18, 261.03 feet; thence leaving said south line N. 29°29'00" E. 160.47 feet to a point on the southerly right-of-way line of County Road No. 154; thence S. 60°31'00" E. along said right-of-way line 210.26 feet to a point on the east line of said Lot 18, a rebar and cap in place; thence leaving said right-of-way line S. 04°25'58" W. along the east line of said Lot 18, 19.57 feet to the True Point of Beginning; containing 0.45 acres, more or less (in the State of Colorado and County of Garfield) ; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutues 1973, as amended, for the reason that this property split is solely for the purpose of adjusting property boundaries and no new lots are created by this addition; NOW THEREFORE, BE IT RESOLVED that the boundary line adjustment of the above described tracts "A" and "B" is hereby exempted from such definitions and said tracts may be adjusted into Tracts "A" & "B", all as is more fully described above. In addition, a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this 16th day of May A.D. 1983.
