HomeMy WebLinkAbout2.0 Resolution 77-117o R E S O L U T I O N+7l-tt7 WHEREAS, PHYLLIS B0SC0, has petitioned the Board of County Conrnissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28- .l01 (.l0) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September I, 1972 and anended April I4,'1975, Sections 1.02..17 (d) and 3.02.01 for the division of a three (3) acre tract into two (2) tracts of one (l) acre and two (2) acres, mlre or less, and said three (3) acre tract is more payticularly described as follows: A tract of land situated in the NE%SE% Section 6, Township 6 South, Range 89 West, 6th P.M., and more fully describedas fol lows: o Beginning at 24, whence th bears N. 32o feet alonq th oto 40' rI gt s. 0,l0 40, t^J. No. 24, the p I ess. a point on the North Line of U.S. Highway No. e SE corner of Section 34, T5S, R89W, 6th P.M.,45' E. 1756..l3 feet, thence N. 87o 23' W. 418.8 e North line of U.S. Highway No. 24, Thence N.2 feet, thence S. 87o 23' E.418.8 feet, thence 3.I2 feet to the North line of U.S. Highwayoint of beginning, conta,ining 3 acres, more or WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Conrmissioners of Garfield County, Colorado that she desires said exemption for the purpose of re-sale for the construction of a nntel, which the current commercial zoning of the parcel wilr ailow; and, bIHEREAS, the Petitioner has demonstrated to the satisfaction of the Board that the water and sewer services for said two acre lot would be supplied by the West Glenwood Water and Sanitation Districts, that there is adequate ingress and egress to said tract, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (I973) Section 30-28-t0t (10) (a) - (d) as amended; NOi.l THEREF0RE, upon motion of (Y seconded by )!/ /\I l;tt,?,r,r ( te and carried, said three (3) acre tract of land is hereby exempted from such definition and transfer of said tract may be nnde by division into two tracts of two (2) and one ('l) acres, more or less, all as is |,<- oo npre fully. described above, and further, this exemption is conditioned upon the granting of the necessary water and sewer taps for services from the appropriate water and sewer districts and the obtaining of a proper 'legal description prior to the issuance of any building permit for the parcels.
