BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, ,COLORADO.

WHEREAS, Joel and Marie Bouchard have petitioned the Board of
County Commissioners of Garfield County, Colorado, for an exemption under
C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted September 1, 1972 and
amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division
of a 9.98 acre tract into two (2) tracts of 9.09 and .89 acre tracts, more
or less, and more particularly described as follows:
All that part of NW1/4NW1/4 Section 27, Township 6 South, Range 89
West of the 6th P.M., lying South and easterly of the Three Mile
Creek Road and Northwesterly of the Hughes Garden Ditch, described
as follows:
Beginning at a point on the Northerly line of said Section 27,
also being a point on the easterly line of said Three Mile Creek
road whence the NW corner of said Section 27, bears N88°37'W,
552.52 feet; thence S88°37'E, 138.34 feet along the northerly
line of said Section to a point on the southwesterly right-of-way
line of the County Road; thence S28°50'E, 313.13 feet along said
right of way; thence S5°17'E, 373.01 feet; thence S52°50'W, 266.31
feet to a point on the northerly line of said ditch; thence S84°36'W,
38.90 feet along said ditch; thence S65°33'W., 41.61 feet along said
ditch; thence S57°29'W, 34.00 feet along said ditch; thence S50°22'W,
94.67 feet along said ditch; thence S44°28'W, 153.46 feet along said
ditch; thence S57°49'W, 36.00 feet along said ditch; thence S45°23'!J.,
73.58 feet along said ditch; thence N27°13'W., 457.84 feet to a point
on the Southeasterly line of the Three Mile Creek road; thence N44°
19'E, 92.37 feet along said road; thence N51°59'E., 150.87 feet along
said road; thence N47°32'E., 144.39 feet along said road; thence N36°
58'E., 107.49 feet along said road; thence N29°40'E.,73.09 feet along
said road; thence N22°09'E., 183.98 feet along said road; thence N3°
26'E., 106.62 feet along said road to a point on the northerly line of
said Section 27, the point of beginning. Garfield County, State of
Colorado.
WHEREAS, the petitioners have demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado that they desire said
exemption for the purpose of resale; and,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado that central water and sewer
service will be available in the near future to the .89 acre tract and that the
9.09 acre tract is currently served by acceptable individual water and sewer
systems, that the requested division is in accordance with the general purposes
of the State of Colorado and the County of Garfield and should therefore be
exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended; and,
WHEREAS, Petitioners have agreed to tap onto the central water and sewage
facilities of the City of Glenwood Springs before occupying said .89 acre tract;
