HomeMy WebLinkAbout3.0 Resolution 77-116RESOLUTION X77-r1(� WHEREAS, ROBERT C. DeBACA has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 4.49 acre tract into two tracts of 4 and .49 acres, more or less, and said 4.49 acre tract is more particularly described as follows: A parcel of land situated in the SW4NE4 of Section 6, Township 6 South, Range 91 West of the Sixth Principal Meridian, lying Southerly of the Center of the Highline Ditch and Northerly of the Northerly right-of-way fence of a County Road as constructed and in place, said parcel of land is described as follows: Beginning at a point on the Northerly right-of-way fence of said road whence the East Quarter Corner of said Section 6 bears: N. 89° 49' 50" E. 1616.99 feet; thence N. 760 29' 28" W. 90.26 feet along said right-of-way fence; thence N. 89° 39' 00" W. 523.65 feet along said right-of-way fence; thence N. 000 24' 02" W. 341.91 feet to a point in the center of said ditch; thence along the center of said ditch N. 76° 03' 00" E. 59.03 feet; thence N. 43° 55' 00" E. 60.85 feet; thence S. 71° 05' 00" E. 182.66 feet; thence S. 750 37' 00" E. 60.65 feet; thence S. 73° 06' 000 E. 83.35 feet; thence S. 570 49' 000 E. 50.83 feet; thence S. 790 13' 00" E. 72.37 feet; thence S. 690 26' 00" E. 40.58 feet; thence S. 400 27' 00" E. 63.45 feet; thence leaving said ditch S. 060 17' 58" E. 40.31 feet; thence S. 15o 58' 50" E. 17.46 feet along a fence as constructed and in place; thence S. 03° 18' 44" W. 47.92 feet along said fence; thence S. 010 40' 40" E. along said fence, 111.54 feet to a point on the Northerly right-of-way fence of said County Road the point of beginning. The above described parcel of land contains 4.49 acres, more or less. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado that he desires said exemption for the purpose of adding .49 acre of property to an adjoining tract of land and that no third -party ownership will be created by proposed exemption; and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of I.c�rrZ/ VC l� c<' L)e-? seconded by r/c4 m Ctfirlcje_ and carried, said 4.49 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 4 and .49 acres, more or less, all as is more fully described above and further that said .49 acre tract will be added to an adjoining tract of land and will not result in any third -party ownership.
