BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973, Section 30-28-101 (10) (a) -(d) as
amended, and Subdivision Regulations of Garfield County, Colorado,
adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17
(d) and 3.02.01, Robert C. DeBaca hereby respectfully petitions the
Board of County Commissioners of Garfield County, Colorado, to
exempt by Resolution a division of the easterly most one half_ acre
shown on the attached Exhibit "A" from the balance of the tract shown
on Exhibit "A" and to include said one half acre within the property
described on Exhibit "B" attached hereto (the Exhibit "B" property
lies adjacent to and immediately east of the Exhibit "A" property),
from the definitions of "subdivision" and subdivision land" as the
terms are used and defined in the above cited statute and regulations,
for the reasons stated below:
1) The Petitioner acquired the property described on Exhibit
"A" in 1971 and acquired the property described on Exhibit
"B" in 1977.
2) Both parcels are adjacent to a county road and both are
improved, one with a single-family home and the other with
a schoolhouse.
3) Petitioner wishes to move the boundaries separating the
two parcels westward a sufficient distance to add one half
acre to the property described on Exhibit "B" and to sub-
tract one half acre from the property described on Exhibit

A parcel of land situated in the SWgNE; of Section 6, Township 6 South,
Range 91 West of the Sixth Principal Meridian, lying Southerly of the
Center of the Highline Ditch and Northerly of the Northerly right-of-way
fence of a County Road as constructed and in place, said parcel of land
is described as follows:
Beginning at a point on the Northerly right-of-way fence of said road whence
the East Quarter Corner of said Section 6 bears: N.89°49'50" E. 1616.99 feet;
thence N.76°2.9128" W. 90.26 feet along said right-of-way fence; thence N.89°
39'00" W. 523.65 feet along said right-of-way fence; thence N.00°24'02" W.
341.91 feet to a point in the center of said ditch; thence along the center of said
ditch N.76°03'00" E. 59.03 feet; thence N.43°55'00" E. 60.85 feet; thence
