Cerise Earl Rhodes Mildred Alsdor::' Commissioner Chairman Commissioner Commissioner County Attorney , Clerk of the Board when the following proceedings, among others --were had and done, to -wit: RESOLUTION NO. 83-286 A RESOLUTION GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR GEORGE DEMOS. WHEREAS, George Demos has petitioned` the.Boardof County`Commissioners of Garfield County, Colorado', for an exemption. from the definition of the terms "subdivison" and "subdivided land" under C.R.S. 1973, 30-28-101,(10) (a)' -(d), as amended, and the Subdivision'Regul.at'ions of Garfield County, Colorado, adopted January 2, 1979, Sections 2:02:21:(d) and 3:.02.01 for the division of a 1.99 acre tract described as followsc TRACT A: A parcel of land situated in the SW1/.4..of Section 5, Township 6.South, Range 89 West of the Sixth ,Principal Merdian, County of Garfield, State of Colorado;. being more.particularly described as follows: Commencing at the Southwest Corner of Section 35, Township 6 South, Range 89 West of the 6th Principal Meridian; thence S. 34°17'00"E. 2031.15 feet to a point on the northerly right-of-way line of State Highway No. 6 & 24 the True Point of Beginning; thence N.01°54'30"E. (and bounded on the west by Reception No. 289643) 242.49 feet; thence S.88°17'43"E. 168.65 feet; thence S.01°51'00 "W. (and bounded on the east by Reception No. 205907) 262.28 feet to a point on, the northerly right-of-way line of said Highway; thence N.81°36'30"W. along said northerly right-of-way line 170.00 feet to the True Point of beginning; containing 0.98 acres, more or less. Subject to a 28.00 foot access easement. TRACT B: A parcel of land situated in the SW1/4 of Section 5, Township 6.South, Range 89 West of the Sixth Principal. Meridian, County of Garfield, State of Colorado; being more particularly described as follows: Commencing at the Southwest Corner of Section 3.5, Township 6 South, Range 89 West of the 6th Principal Meridian; thence S.38°44'39"E. 1841.03 feet to the True Point of Beginning; thence N.01°54'30" E. .(and bounded on the west by Reception No. 28,9643) 277.66 feet to a point on the Southerly right-of-way line of County Road No. 130; thence S.72°48'43"E. along said right-of-way line 55.04 feet; thence S. 83°34'46"E. along said right-of-wayline 115.65 feet; thence S.01°51'00"W (and bounded on the east by Reception No. 205907) 253.46 feet; thence N.88°17'43"W. 168.65 feet to the True Point of Beginning; containing 1.01 acres, more or less. Together with a 28.00 foot access easement; and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado,m that the proposed division does not fall within the purposes of Part 1, Article 28, BOOK 635 PAGE 9 Title:30,_Colorado Revised'Statutes :1973., as. amended, for the reason that the impact created does not' -warrant furtber'subdivision review, and WHEREAS. the Petitioner has demonstrated to the satisfaction of. the. Board of Cunty Commissioners of Garfield County, Colorado, that there is domestic water on each of the said tracts, that there is adequate ingress and egress to said tracts, that the requested division is not part of an existing or large development and.deos not fall within the general purposes and intent of the subdivision -regulations of the. State of Colorado -and the County of Garfield, and shoud, therefore, be_exempted from; the definition of the terms "subdivision" and "subdivided land" as. set forth in C..R.S 1973, 30-28-101 (10) (a) -(d), as amended; NOW THEREFORE, BE IT'..RESOLVED that the division of --the above described tracts."A" and "B" from the above 1.99 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B:-, all :as is more fully described above, and said divided tract may be con- veyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that th isexemption is granted on the condition and with the express understanding and agreement 'of ithePetitioners that no further exemptions be allowed on said tracts "A" and -"B",- and that a copy of the instrument or intruments of conveyance when recorded shall be filed with this Reso- lotion.
