BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed Allan and Joyce Bowles
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 10.46 acre tract of
land into two
tracts of approximately 7.0 and 3.46 acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101.(a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
To establish two building sites with acreage.
In support of this petition the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access.
(b) Vicinity Map.
(c) Statement on source of domestic water.
(d) Statement on method of sewaae disposal.
(e) 100 year floodplain information where
live stream crosses or adjoins said tract.
(f) Fee in the amount of $

(c) Source of Domestic Water We have one well permit already granted
which will be used on the smaller tract and we have applied for another
well permit which. can hopefully be used on the larger tract.
(d) Sewage Disposal Disposal system will meet county standards; septic
tank and leach lines.
(e) Floodplain information does not apply since a live stream does not cross
nor adjoin the tract.

as follows:

Beginning at a rebar found in place and accepted as the Northwest
corner of said Parcel No. 2, and the Northeast corner of Parcel
No. 1;
thence N. 88°05'17" E. 283.83 feet to a rebar found in Place
and accepted as the Northeast corner of said Parcel No. 2;
thence 106.54 feet along a curve to the left with a radius of

Dear Ray:
This letter is to confirm our telephone conversation. If the split
of Tract 4, Chelyn Acres, owned by Allan Bowles is allowed, I intend
to purchase the upper or West Tract, and supply water to it from my
Domestic Well located on Tract 5, next to the purchased ground.
The County Commissioners, as you remember, have previously okayed the
split of Tract 5, pending a survey. This would mean that the above
Domestic Well would be supplying water to three tracts, with event-
ually one house on each tract.

exemption application. Unfortunately, no location by Section, Township,
and Range was submitted and we cannot provide comments concerning the
water supply. Due to this, we request that this proposal be held in abey-
ance until such time as we have reviewed additional material submitted
by the applicant and returned comments to the County.

We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water which
is tributary to Four Mile Creek, an over -appropriated stream. Since new
wells could cause the injury to senior vested water rights, well permits
cannot be issued by this office and we cannot recommend approval of the
Bowles Exemption.
