BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION NO. 79-102 BOOK 535 PAGE WHEREAS, Allan A. Bowles has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 10.46 acre tract described as follows: that parcel of land as described in Document No. as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approximately 3.073 and 7.424 acres each, more or less, which proposed divided tracts are more particularly described as follows: Tract A: A tract of land situated in the West 2 of Section 3, Township 7 South, Range 89 blest of the Sixth Principal Meridian, described as follows: Beginning at a rebar found in place and accepted as the Northwest corner of said Parcel No. 1 and the Point of Beginning; thence N. 88°06'05" E. 712.60 feet to a rebar found in place and accepted as the Northeast corner of said Parcel No. 1 and the Northwest corner of Parcel No. 2; thence S. 03°15'34" E. 262.98 feet; thence S. 09°16'22" W. 201.01 feet to the Southeast corner of said Parcel No. 1 and the Northwest corner of Parcel No. 4; thence S. 88°15'12" W. 670.85 feet to a rebar found in place and accepted as the Southwest corner of said Parcel No. 1, and the Northwest corner of Parcel No. 3; thence N. 03°01'50" W. 458.41 feet to the Point of Beginning; said parcel containing 7.424 acres. Tract B: A tract of land situated in the West 1 of Section 3, Township 7 South, Range 89 West of the Sixth Principal Meridian, described as follows: Beginning at a rebar found in place and accepted as the Northwest corner of said Parcel No. 2, and the Northeast corner of Parcel No. 1; thence N. 88°05'17" E. 283.83 feet to a rebar found in place and accepted as the Northeast corner of said Parcel No. 2; thence 106.54 feet along a curve to the left with a radius of BOOK 535 PAGE304 331.88 feet, and a chord bearing of S. 02°40'29" W. 106.09 feet; thence S. 06°31'20" E. 356.47 feet to a rebar and cap found in place and accepted as the Southeast corner of said Parcel No. 2, and the Northeast corner of Parcel No. 4; thence S. 88°15'11" W. 336.81 feet to the Southwest corner of said Parcel No. 2, and the Northeast corner of Parcel No. 3; thence N. 09°16'22" E. 201.01 feet; thence N. 03°15'34" W. 262.98 feet to the Point of Beginning; said parcel containing 3.073 acres. Tract A and Tract B are located in the State of Colorado and County of Garfield; and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is not great enough to proceed through the full sub- division review; and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County CommiFsioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; and WHEREAS, the division of the above described tracts "A" and "B" from the above described 10.46 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tracts "A" and "B", and that a copy of the instrument or instruments of conveyance when recorded filed with:: this Resolution. ed this :1Oth`';day :`,of :September.::.•;; ;A:;D;.` 1979:" BOOK 535 PAGE` THE BOARD OF COUNTY COMMISSIONERS or-GARFIELD COUNTY, COLORADO Chairma 0 _ Depity : C1 eifk ofthe Board of County ommissioners Garfield County, Colorado. gsz
