Reference: Amended Plat for Cooperton Townsite — File No. FPAA8134
Mr. and Ms. Cyr:
Garfield County Community Development is in receipt of the application to amend the
common lot line between Cooperton Townsite, Block 3, Lots 1-11 and Cooperton
Townsite, Block 2, Parcel 1. This application was received on November 4, 2014 and
has been reviewed for technical compliance with the Garfield County 2013 Land Use
and Development Code, as amended. It has been determined that the following items
are deficient and therefore further processing and review of the application cannot occur
until the following information is received:
1. The application form submitted does not clearly identify the property that is being
amended in the draft plat. Please amend the application form as follows:
a. Parcel 1, Block 2 of Cooperton Townsite is the `receiving' lot of the 535
square feet. The parcel number for this lot is 2393-284-02-003.
b. The above reverenced parcel is currently owned by Christopher William
Follen and Katherine Sarah Rosen. These owners are required to be co -
applicants and therefore must be included as an applicant on the application
form and sign as a co -applicant.
c. Parcel Number 2393-283-03-002 is listed on the application form however it
does not appear to a part of the request. Please clarify this issue.
If Barbara Cyr is to represent the current property owners of Parcel 1 then a
d. a
letter of authorization from Follen/Rosen will be required.
e. Please provide the legal descriptions of the properties on the application form.

4. An electronic version of the submittal documents must be provided, such as a
CD containing a copy of the application and all attachments including the plat.
5. Provide a map from the assessor's office that clearly identifies those parcels that
are within 200 feet of the boundaries of the plat amendment.
6. It appears that several adjacent property owners are missing from the list
provided. It is the responsibility of the applicant to assure that all owners within
200 feet of the subject sites are included on the list to be noticed of the request.
7. No information was provided regarding mineral ownership of the subject sites.
Please provide this information along with how the research was completed.
8. The application contained a copy of a release of deed restriction regarding Parcel
1. Insufficient information has been provided to demonstrate that the restriction
has been released:
a. The release form incorrectly references Rec to ber 537724 as the
Warranty Deed. The correct Reception Numb r is 639102.
b. Once corrected, the Release of Deed Restriction is equired to be recorded.
9. The application included D_oLixstr-these are not jmuired and should not
—be—it-tofu in the application materials due to the sensitive nature of the
informa 'on -contained in these documents.
10.A draft amended plat was provided. Please amend th plat to conform with
County requirement
a. Include Follen/Ros q as an owner.
b. The Title Commitment `information ould be referred to on the plat with
recorded easements, if anY.

c. The plat should reference th amended plat of Lots 17-21, Block 2 at
Reception Number,2t43.

The Garfield County Land Use and Development Code, as amended stipulates in
Section 4-101 (B)(2)(a) that the Applicant has 60 days from the date of this letter to
correct these deficiencies.
