Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned &t2k kie-NOVL

Board of County Convnissioners of Garfield Courjty, Colorado, to exempt by resolu-

"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (10) (a) -(d) and the Garfield County Subdivision Regulations,

Reasons for exemption:
1) To correct an existing condition of two (2) homes on one(1)
tract.
2) To provide for one(1) additional tract to be deeded to
"son(s) and daughter" as provided by the exemption regulations
paragraph 1.
3) The division being applied for is wholly contained in a tract
which I have owned for over 5 years, as per paragraph 6 of
the exemption regulations. (See Attached Deed)
In support of this Petition, the petitioner also submits the following:
D. Statement on source of domestic w;ter...Domestic Water will be
supplied to the three(3) tracts 15.1, 5.4, and 4.1 acres by a
community water system; present well pumps 15 gpm and a storage
tank is proposed to be situated next to the barn.

E. Statement on method of sewage disposal...Two(2) existing homes
(on Proposed 5.4 ac and 15.1 ac tracts) are currently served by
individual, on site, septic systems. The proposed 4.1 ac and
35.2 ac tracts will be served by the same type of systems;
designed in compliance with the current county environmental
health regulations.
F. FLOODPLAIN INFORMATION... There are no live streams which cross
or .djoin any of the proposed tracts.(Floodplain--not applicable)

On 4/24/79 the pump at the Arnove residence was replaced. The
pump that was replaced was a 3/4 hp. Reda submersible. It was replaced
with a 1 hp. Sta-Rite submersible pump Model 8SP4E02E. The max. pumping
rate with this pump is 15 gpm: My records show that this pump is set
at approx. 148' and the standing water level was at approx. 118' at the
time the pump was replaced. If you have any additional questions please

We have reviewed this proposal to separate 60 acres into tracts of 4.1,
5.4, 15.1 and 35+ acres. There are homes on the 5.4 and 15.1 acre tracts
already. Well number 31599 (issued August 1, 1967) is the proposed source of
water for the three smaller tracts. The applicants will seek a new well on
the 35 acres. Our comments follow:
1. We have no authority to recommend expanded use of well 31599 and as a
general policy, we would discourage an expanded use of such a well.
However, the proposed use is not illegal and would remain within the
standards of an exempt well.
2. If a domestic well is used to serve more than one lot, we would
recommend joint ownership, an operation and maintenance agreement,
and any necessary easements.
3. We can make no indication concerning the availability of a domestic
well on 35 acres other than to say that these wells are available
pursuant to CRS 1973, 37-92-602(3)(b)(II).
4. Thirty-five acre parcels are not subject to SB -35, therefore, if the
county approved this proposal, we could not object and the avail-
ability of a well on the 35 -acre tract would not be adversely
affected. We would make a well permit available with a condition
that it could only serve one single-family dwelling since it involves
an exemption. It is our policy to approve a one-time exemption and
not to allow additional lot splits in over -appropriated basins.
