Sheet 1 is an exact duplicate, with no changes in the location of the lot lines, as filed in your office some time ago. As can be seen in this exemption map 4 building lots have already been approved with Lot 1 and Lot 2 already having improvements located as shown. Lot 3 and Lot 4 have no improvements. A domestic well, already existing on Lot 2, is approved for 3 households with Lots 1,2, and 3, as shown on Sheet 1 sharing a deeded 1/3 interest in this existing well. The Colorado Division of Water Resources has issued Permit No. 155461(expires Sep 28, 1991) for a well located as shown on Sheet 2. This permit is for a domestic well. The Lot lines and well locations are as they exist today. As can be seen from Sheet 1, Lot 1 has no access to Red Canyon Road ex- cept by the existing driveway thru Lot 4. Lots 2 and 3 also have no access to the county road except thru Lots 1 and 4. Also, as shown on Sheet 1, the lot lines are, internal to our 59.12 acre parcel, very irregular with Lot 1 looping around an existing barn in the NW corner, and Lot 3 completely surrounded by Lots 1,2 and 4. It is my proposal that you allow me to amend these internal lot lines as shown on Sheet 3 in red. This proposed amendment would not change the number of already improved building sites, nor would it change the location or usage of the existing well on Lot 2, or the Permit 155461 location for the well now shown on "Lot ;'i3". This already permited well would serve Lot 3 and Lot 4 building sites (two separate households plus a potential guest house on one of the two parcels). The 1/3 interest in the well now existing on Lot 2 and reserved for a building on Lot 3 as Shown on Sheet 1 would be changed to be assigned to a potential future guest house on the amended Lot 1 as shown on Sheet 3. Also, as proposed on Sheet 3, the changes in the internal lot lines would straighten out the irregularities now existing, increase the size of Lot 1 from 13.63 A to approximately 28A, Lot 2 from 6.47A to approximately 8A, Lot 3 from 4.O1A to apprximately 11.5A, and decrease Lot 4 from 35.01 A to approximately 11.5A. This decrease in the size of Lot 4 would not change the already permited use of the future well authorized. A new driveway would be constructed, as shown by the dotted red line on Sheet 3 to permit access to Lot 2 and 3 directly from the county road. I have already had verbal approval from Grant Poplin of the Garfield County Road District to build page 2 dated October 18,1990 this proposed driveway. This proposed location requires only slight grading to remove the sage bushes prior to a layer of 1=3 bedrock, and a culvert in the existing ditch where this driveway would enter the county roar. The slope of this drive would be slightly downhill from the county road and would not pose any water or visual problem to the county road. The exisying driveway on Lot 1 enters the county road approximately 1550 feet to the SE of this proposed new drive and are far enough apart so they pose no traffic problems for entering onto the county road. In summary,my proposed amendment to the Arnove Exemption Map shown on Sheet 1 would not increase the number of building sites already approved, nor would it change the already approved usage of the wells on my 59A parcel, and represents an improved land use by not having building sites land locked from the county road. If this draft proposal meets with your approval I will have a licensed land surveyor modify the Arnove Exemption Map as shown on Sheet 3, obtain a driveway permit as discussed , and request the Colorado Division of Water Resources to change Permit No. 155461 from Zito to Simmons and refect the changes in the legal description of the well location with no change in thee?l4Ecation described in paragraph (6) of the existing permit.
