HomeMy WebLinkAbout2.0 Resolution 77-577 \r.o RESOLLITI t)N I tl -sl WHEREAS' PAUL AMICHAUX, has petitioned the Board of County Commissioners of Garfield county, colorado, for an exemption under c.R.s. (tsz:1 section 30-28-l0l (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September l, 1972 and amended Apri'l .l4, 1975, Sections 1.02.17 (d) and 3.02.0.l, for the division of a 57.96 acre tract of land into five (5) tracts of approximately .73,6,22,9, and acres, more or less, and more particularly described as follows: Lots 4,5, and 6 jn Section 6, Township 6 South, Range 89 West, 6th P.M., lying on the northerly side of the Colorado River. Less and except, however, those portions heretofore conveyed out by Document Nos. 70488, 164727, 210979, .l89029, 211680, of the Records of Garfield County, Colorado. EXCEPT all that part of the above described tract lying southerly and easterly of the Courrty Road commonly known as the Mitchell Creek Road as presently constructed and in p1ace. Together will all water and water rights, ditches and ditch rights appurtenant to or used upon or in connection r,lith sai d prcoerty. A tract of land situated in Lot 4 cf Section 6, T65, R89W. of the 6th P.M. and rnore fully described as follows: Beginning at a point whence the Southwest Corner of Section 34, T5S, R89W, of the 6th P.M. bears N. 39o l7' E. 1005.5 feet; thence N. B9o 08' 30" E. .l.l97.2 feet -to the Westerly line of the County Road, thence S. 43o 17' [{. 238.0 feet along the tlesterly line of the County Road; thence S. 370 l6't^1. .I38.6 feet along the l^Jesterly line of the County Road; thence S. 55o 28'i,l. 296.55 feet along the Westerly line of the County Road; thence S. 500 l3' l^l. 123.04 feet along the Westerly lien of the County Road; thence S. 360 26'W. .l55.8 feet along the Westerly line of the County Road; thence S. 280 ll'l{. 177.1 feet along the Westerly l'ine of the County Road and the Northerly line of U.S. Highway 6 and 24; thence S. 74o 16'l,J. 144.0 feet along the Northerly line of U.S. Highway 6 and 24; thence N. l60.5l' W. 340.45 feet along the cinter of a gulch; thence N. 21o 23'W.543.78 feet along the center of the gulch to the point of beginning; and containing 1.l.73 acres, more or less. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said eiemption for the purpose of re-sa'le into s.ingle-family residential acreage; and, o - o'o WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of Iocating domestic water on each of said tracts of 22, 9, 15.23, and ll acres, and that said .73 acre tract would obtain water from the West Glenwood Water District, that there is adequate ingress and egress to said tracts, that all proposed tracts wilt obtain sewage treatment service from the l.lest Glenwood Sanitation District, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (tSZS1 Section 30-28-10I (10) (a) - (d) as amended; NOt{ THEREF0RE, upon motion of Flave"n@.erise seconded by Lar Ve O€Z-and carried, said 57.96 acre tract of ]and is hereby exempted from such definition and transfer of said tracts may be made by division into tracts of.73, 11,22, 9, and'15.23 acres, more or less, and further, prior to conveyance of any said tracts a proper lega1 description be developed.
