(1973) Section 30-28-101(10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, Elmer J. Arbaney respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution a division of the property des- cribed on Exhibit "A" from the property outlined in red on Exhibit "B," from the definitions of "subdivision" and"subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30 -28- 101(a) -(d) and the Garfield County Subdivision Regulations, for the reasons stated below: 1. The property described on Exhibit "A" has contained a single family home for many years. 2. The home is equipped with an existing water system and sewage disposal system. 3. Access to the property described on Exhibit "A" is obtainable over and across other lands of the Petition and public lands to a county road over an existing road which is shown on Exhibit "B." 4. Petitioner contemplates conveying the property shown on Exhibit"B" to a corporation of which he will be a stock- holder, officer, and director, but he wishes to reserve to him- self the property described on Exhibit "A," Submitted at Glenwood Springs, Colorado, this 13th day of January, 1977. The sewage disposal system referred to in Paragraph 2 of the petition consists of an out -house. 2. Petitioner hereby offers that a condition be imposed upon the granting of the exemption sought in this peti- tion to the effect that no human occupancy will be made of the property described on Exhibit "A" attached to the petition until a sewage disposal system meeting the re- quirements of all applicable state and county regulations has been installed and is functioning. 3. Plat dated 1922, all in Section 31, Town- ship 7 South, Range 89 West of the Sixth Principal Meridian, County of Garfield, State of Colorado, said parcel of land is described as follows: Beginning at a point whence an iron post with a brass cap found in place and properly marked for the Witness Monument to the West Quarter Corner of said Section 31 bears: S.46°11'16" W. 1796.12 feet; thence S.35011'57" E. 310.00 feet; thence S.54048'03" W. 310.00 feet; thence N.35°11'57" W. 310.00 feet; thence N.54°48'03" E. 310.00 feet to the point of beginning.
