RESOLUTION 44'11-1q
WHEREAS, ELMER J. ARBANEY has petitioned the Board -of County Commissioners
of Garfield County, Colorado for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 117 acre tract
into two tracts one of approximately 2.20 acres, more or less and more
partucularly described as follows:
1: A parcel of land situated in the EZNW' and in Lot 2
and Lot 6 according to the G.L.O. Plat dated 1922,
all in Section 31, Township 7 South, Range 89 West
of the Sixth Principal Meridian, County of Garfield,
State of Colorado, said parcel of land is described
as follows:

Beginning at a point whence an iron post with a brass
cap found in place and properly marked for the Witness
Monument to the West Quarter Corner of said Section 31
bears: S. 46° 11' 16" W. 1796.12 feet; thence S. 35°
11' 57" E. 310.00 feet; thence S. 540 48' 03" W.
310.00 feet; thence N. 35° 11' 57" W. 310.00 feet;
thence N. 540 48' 03" E. 310.00 feet to the point of
beginning.
The above described parcel of land contains 2.20 acres,
more or less.
and the other of approximately 114.8 acres, more.or less, more particularly
described as follows:
2. Lots 6, 2 and 7, SWl SWQ, NEW1/4, S1/2 and NWQ and StP1/4NE4 of
SEQNW;; and SZ SW1/4NEQ all in Section 31, Township 7 South,
Range 89 West, except for the parcel of 2.20 acres
described above.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of conveying the 114.8 acre tract and reserving
the 2.20 acre tract as single-family residential acreage, and;
WHEREAS, Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that
the location of septic tanks will be permitted by the Colorado Department of
Health, that the requested division is in accordance with the general
purposes and intent of the Subdivision Regulations of the State of Colorado

and the County of Garfield and should therefore, be exempted from the.
definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. (1973).Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of .,,,W.L'Y1 seconded by
, and carried, said 117 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by
division into two tracts, one of 2.20 acres, more or less, all as is more
fully described above, and further that an individual disposal system
permit shall be applied for with Garfield County and that prior to occupancy
of the existing residential unit on the 2.20 acre parcel, said unit shall be
provided with a sewage disposal system meeting all the requirements of
Garfield County and the State of Colorado. A copy of the instrument or
instruments of conveyance when recorded shall be filed with this Resolution.
