PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
ie Subdivision Regulations of Garfield County, Colorado, adopted September 1,
X972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned

petitioners the Board of County Commissioners of Garfield County, Colorafdo, to
exempt by resolution the division of 6. acre tract of land into 4F2
tracts of approximately gpit acres each, more or less, and
which tract to he subdivided is more particularly described as follows:

from the definitions of "subdivision" and "subdivided land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:

(For purposes other than irrigation, to -wit, domestic purposes)
The claimants of said pipeline are Emery E. Arbaney and Beulah
Arbaney.
The source of supply of said pipeline and of the appropriation
awarded herein is an un -named spring. Said spring is in the Four Mile
Creek Drainage Area, but does not contribute to the flow of said Four Mile
Creek.
The Headgate or point of intake of said pipeline is situate
in Garfield County, Colorado, at a point whence the Southeast corner of
Sec. 15, Tp. 7 S., R. 89 W. of the 6th P.M. bears South 73°447 East, 1864
feet.
The purpose for which the water diverted through said pipeline
is used is for domestic purposes and sprinkling lawns.
The priority date to which the appropriation is entitled is
August 18, 1931. Said appropriation was made by original construction.
Said pipeline is entitled to No. X73 for purposes other than irrigation,
that is, for domestic purposes, for .014 of a cubic foot of water per
second of time.
IT IS THEREFORE ADJUDGED AND DECREED that there be allowed to
flow into said pipeline, for the use and benefit of the parties lawfully
entitled thereto, under and by virtue of original construction, Priority
No. !'-- for .014 of a cubic foot of water per second of time.
