Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned Anvil Points P '
respectfully petitioners the
Board of County Commissioners of Garfield Courjty, Colorado, to exempt by resolu-
tion the division of
622 acre tract of land into 2 tracts of
approximately 10 acres and 612acres emoty,
more or less, from the difinitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (10) (a) -(d) and the Garfield County Subdivision Regulations,

EXHIBIT "D" to Petition for Exemption
Source of Domestic Water,
Method of Sewage Disposal and Floodplain Information
No water is currently adjudicated, however domestic use is
not anticipated. The property is contiguous to the Colorado
River and is subject to its floodplain. The newly created
tract will have individual treatment systems which will comply
with State and City regulations. The newly created tract will
contain less then 35 acres.

Senate Bill 35 Exemption Applications
Dear Terry:
In response to your letter of August 16, 1981, my clients
are commissioning a Flood Plain Study for the Swartzendruber
Exemption request. They are waiting for an estimate of
total costs before proceeding on that particular item.
We have submitted well applications for domestic wells on
each of the proposed parcels. Copies of those well appli-
cations are enclosed for your information.
Also enclosed are copies of the maps of each of the parcels
showing the entire ownership of Anvil Points, Ltd. in the
area and the boundaries of the respective splits. Please
advise if you need additional information.
I would request that you consider each of the applications
to be amended to indicate that water supply will be from
domestic ground water wells with permits applied for as
indicated.

Dear Terry:
Enclosed please find copies of the well permits for each of
the Anvil Points properties for which subdivision exemptions
were granted in October. These should fulfill the conditions
the Commissioners had placed upon approval of the subdivision
exemption request. Also enclosed are revised descriptions
of the two tracts to be exempted. The parcels have now been
surveyed and, therefore, the description varies very slightly
and is more particular than that used in the original
application. Please call me immediately if this presents
any problems.

59DE-Nihill channery loam, 6 to 25 percent slopes. This deep,
well drained, moderately sloping to hilly soil is on alluvial fans and
valley sidesiopes. It formed in alluvium from Green River shale and
sandstone. Elevation ranges from 5,000 to 6,500 feet. The average
annual precipitation is about 13 inches, the average annual air temper-
ature is about 48 degrees F., and the average frost -free period is
about 125 days.
Typically, the surface layer is light gray channery 18am about 11
inches thick. The subsurface layer is very pale brown stony loam
about 7 inches thick. The underlying layer is very pale brown extremely
stony and channery loam that extends to a depth of more than 60 inches.
Included with this soil in mapping are small areas of Arvada
and Ildefonso soils which make up 10 to 15 percent of the mapping unit.
Arvada soil is found on the moderately sloping areas and Ildefonso
soil is on the steeper portion of the landscape.
Permeability of the Nihill soil is rapid. Effective rooting
depth is 30 to 40 inches. Available water capacity is low. Surface
runoff is slow and the erosion hazard is high.
This soil is used mainly for livestock grazing and wildlife
habitat.
The native vegetation on this soil is mainly bluebunch wheat -
grass, Indian ricegrass, serviceberry, and big sagebrush,

When the range condition deteriorates, forbs and woody shrubs increase.
When the range is in poor condition, undesirable weeds and annual plants
are numerous. Proper grazing management maintains and improves range
condition. Seeding is a good practice on slopes of less than 15 percent
if the'range is in poor condition. Careful selection of areas is necessary
because of stoniness and shallow depth to bedrock. Suitable plants for
seeding are crested wheatgrass, western wheatgrass, and Russian wildrye.
For successful seedings, a good practice is to prepare a seedbed and drill
the seed. A reduction in brush on slopes less than 15 percent improves
deteriorated sites. Care is required not to destroy desirable shrubs.
Wildlife using this soil for habitat include mule deer, cotton-
tail rabbit, chukar, and squirrel.
The potential community development of Nihill soil is limited by
steep slopes, stone and channery content. Community sewage facilities
are needed if population density increases. Capability subclass VIIe.

cobblestone on or near the surface. Water levels fluctuate from
2 to 4 feet and may be near the surface during spring runoff from
snow melt. Areas of this broadly defined unit are subject to
brief occasional flooding during late spring and early summer
months.
Included in the mapping and making up 15 percent of this unit
are small isolated areas of the Wann soils on 1 to 3 percent slopes.
Also included in mapping are small areas of moderate to severely
alkali affected soils identified by an alkali spot symbol. There
are isolated and small areas where water stands near or at the sur-
face year around. These are identified by wet spot and marsh spot
symbols.
AW-Torrifluvents, nearly level 2
The native vegetation is mainly cottonwood, willow, tamarisk
and water tolerant grasses, sedges, and rushes. This unit is often
suited to the production of Fremont cottonwood trees. It is capable
of producing 230 board feet of timber per acre from a fully stocked,
even-aged stand of 40 year old trees.
Some areas of this unit are used for livestock grazing. It
provides shelter and forage where access to these areas is available.
This unit has a definite recreation potential. Wildlife popula-
tions are abundant and the nearness to the river make these areas
available to rafting and canoeing enthusiasts.
Wildlife abound in this vegetative habitat. Mule deer, cotton-
tail rabbits, coyotes, bobcats, ducks, geese, and other native birds
are well adapted and use the native vegetation for food and shelter.
Where it is feasible, development of food plots, tree and shrub
planting, and establishment of nesting cover would enhance the habitat
for upland game.
In areas of perennial high water table, open water may be
developed by blasting or heavy equipment for water fowl usage and
fish ponds.
Community development is very limited on this unit. Flooding,
seasonal high water tables, and variable soil textures require on-site
soil investigations to determine compensating measures at specific
proposed sites. Capability Subclass VIIsw, nonirrigated.
