PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section g0-ZB-l0l(10)(a) - (d) as arnended,
and the Subdivision Regulations of Garfie'ld County, Co]orado, adopted
September 1,1972 and amended Apri'l .|4, 1975, Sections 1.02.17(d) and
3.02.0'l , the undersi gned Charles W. and Carol K. Baker
respectfully petitions the Board of County Commissioners of Garfield .
Countyr'Colorado, to exempt by resolrllon a parcel of land situated in the sL sI{% of
Section 23, and in the N% NW% of Section 26, all in township 7 south, Range 92 west of
the 6th P.M.Coun of Garfield contai 59.4L acres 1ess.

and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-l0l(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated be]ow:
To allow the division of Lhe property into four parcels of approximately 15 acres
each as per attached Plat.

Re: Baker Exemption
Dear Mr. Witkowski:
This is to acknowledge receipt of information pertaining to the
above referenced exemption which will create 4 lots on 59 acres in the
Mamm Creek drainage. Since this is in an over appropriated watershed ,
this office cannot recommend approval due to the injurious effect of
4 new we1ls.
The letter from Mr. Chuck Baker makes reference to existing
houses and wells on the exemption; hourever, additional information on
these wells was not provided. We would recommend that information on
the location, permit numbers, date constructed, depth and use of these
wells be provided. It may be possible that the existing wells will or can
be used in a manner to allow the exemption to be approved by this office.

my property as described.
I have enclosed a surveyors plat showing the existing homes and their wells.
If additional information is needed, please let me know so that I may
provide it it prior to your placing this on the Commissionerts agenda, which
will hopefully be during the latter part of June.
