RELATTONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District B subdivisions/Ruralserviceable Areas 0 to I mile radius as designated on theGarfield coUnty comprehensive plan Management Districts, Map.
DESCRIPTTON OF THE PROPOSAL
A Site. Description: The site is gently sloping drylandfarmland. There is currently a mobile home on theproperty, which has been permitted but not set up. Theproperty is traversed by numerous utility 1ines includingtwo (2),230 kV electrical transmission lines (see map onpage lo I .
Project, Description: The applicant is requesting anexemption to split the subject property into three (3)separate parcers of 24, L2 and 13 acres. Arso incrudedis a 900 sguare foot outlot for a shared weII.
III. MAJOR ISSUES AND CONCERNS
1-. The appricants are proposing to drill a well on Lot 2.This werr wourd be shared by the 3 rots and governed bya well sharing agreement. No well permit has been issueito date. Arthough the property is traversed by ditchesand pipelines, afparentiy fne ippricant has no iignts tothe water.
Concerns have been raised about the ability to reachgroundwater at a reasonable depth. No responle has beenreceived from the Division of water Resouices.

driveway(s) might eliminate the proliferation of roadcuts.
The proposed lots wiII be serviced by I.S.D.S. SoiIconditions should not preclude the use of conventionalseptic tank/leach field systems.
The subject property is traversed by numerous utilitiesand their attendant easements, dramatically reducing theusable acreage of the parcels. These utilities includefour (4) power lines, one (1) telephone, one (1) utility(beacon), one (1) buried water line (providing water tothe airport) and one (1) ditch easement. Concerns have
been raised about the health effects of residing in closeproximity to high voltage electrical lines.

The property to the north and west is a portion of theAirport Industrial Park PUD. Adjacent lands are zonedfor industrial and commercial activities. Staff hasconcerns about increasing the potential for conflict
between the proposed residential uses and the industrial,commercial and aviation uses.
IV. SUGGESTED TINDING
1 That proper posting and public notice was provided asrequired for the meeting before the Board of County
Commissioners.

2. That the meeting before the Board of County Commissionerswas extensive and complete, that all pertinent facts,matters and issues were submitted and that aII interestedparties were heard at that meeting.
3. That for the above stated and other reasons, the proposedexemption is in the best interest of the health, safety,morals, convenience, order, prosperity and welfare ofthe citizens of Garfield County.
RECOMMENDATTON
rf the commissioners are inclined to approve the application,then staff recommends that approval be subject to thefollowing conditions:

1. That aII representations of the applicant, either withinthe application or stated at the meeting before the Boardof county commissioners, sharl be consldered conditionsof approval.
2- That-the applicant shall have 120 days to present a platto the commissioners for signature. Extensions of Lime
may be granted if requested prior to the expiration date.
3. That the following plat notes be included on theExemption plat:

That the applicant submit $200 in School Impact Fees forthe creation of each new lot.
The applicants shall demonstrate availability of domesticwater by providing well permits prior to the approval ofthe p1at. The applicant shall provide the documentationfrom a registered professional engineer or a qualifiedgeologist demonstrating availability of water.
A weII sharing agreement shall be provided prior to theapproval of the plat and shall be recorded in conjunctionwith each deed conveying well ownership.
A driveway permit for all lots shall be obtained from the
Road and Bridge Department prior to the approval of theExemption Plat.
